SPECULAITONS BECOME REALITY.. INSTRUCTIONS FOR RRs ISSUED BY THE BOARD


At last, as foreseen by this site, the CBDT has served stale food after cooking for 2 months. Today, the CBDT has issued an instructions wherein it stated 'draft rules can not form the basis of promoitions, when rules to the contrary are holding the field'.  We must 'congratulate' the CBDT for taking this 56 long days for inventingg this SC's observation.

So, as of now, there is no hurdle to CCsIT from the CBDT side to conduct DPCs for Gr-B & C posts.  It further stated that the instructions issued today will be applicable for Vacancy year 2013-14 and separate instruction will be issued for 2014-15.
The million dollor question is, what is the necessity to create new grade of EA, while giving promotions in the old pattern after getting approval of posts for new grade?

the indecisive and brainless CBDT has got this idea and SC order copy from the small and over smart section who will benifit at large extent by depriving their seniors. It sat idle until it is influenced by 'somebody'. right?

Kya ho babua! jis thali me khate ho us thali me ched karto ho ka, CBDT ka anaj khake CBDT ko gali karto ho saram nahi ata! tumara retirement kab hai , farewell bhi nahin milega. Kahe ka senior ho bhai, tum sirf tumare ghar me chhote bhai aur chhote. bahan senior ho aur kisise nahin. CBDT ko mafi mango, CBDT bhagwan hai. CBDT tum ko naukari dia hai bhai. CBDT Jo bhi decision late hai sab ki bhalai me liye hota hai. Thanks to CBDT. Jai hind! Jai Bharat! Jai CBDT!.

This is reality that from grade pay of 4200 to 4600 min length of service is 3 yrs irrespective of recruitment rule. So newly Sta have to wait

Please see the para No.5 of the HRD letter dated 27-05-2014 with regard to recruitment rules.Some of the states are giving promotions to the next higher grade without observing the said para No.5 and also without completing the basic limitation ie 3 years in the previous cadre they are giving promotion using the discretionary power without knowing the actual meaning of the discretionary power and so that this power leading into creation of problem to other states and encouraging the in-eligible cadre in approaching CATs/courts with this rejoinder. hence, request do not use the discretionary power for eligible service but use the power for giving fitness in giving promotions. For promotions two conditions are to be satisfied. One is eligible service/eligibility to get promotion. 2nd one is fitness ( conduct etc). So, use the discretionary power for the 2nd one but not the first one. If its uses for the first one it leads to violation of the DoPT instructions. So kindly keep in mind and ask the in-eligible service candidates wait for their turn even though there are vacancies to be filled up. All the CCITs are requested to pay attention in following the uniform method whether it is wright or wrong.

Yes, in some states are giving promotion to the cadre inspector to the Sr.TAs without completion of 3 years in the said cadre in that particular state. Some Sr.TAs are transferred to their respective state but they have to put in the cadre TA and after that those candidates have to complete 3 years in their state and complete 3 years in Sr.TA cadre in that state, then only they are eligible to get promotion to the cadre Inspector. Though there may be vacancies in inspector cadre, it should be carry forward and it was clearly mentioned in DoPT instn 3.7.86. Not only this it is also violation of recruitment rules of Inspector cadre where in it was clearly mentioned about the eligible service and its feeder cadre.So do not mislead the CCITs to use discretionary power and lead them into violation of fundamental rights of the candidates of other states and the serving employees of that particular state.

AS PER THE INSTRUCTIONS OF THE CBDT, THE OLD R.R. IS TO BE TAKEN AND IMPLEMENTED. THE BLOGGER HAS RIGHTLY POINTED OUT AND ON WHAT BASIS THE EXECUTIVE ASSISTANT POSTS CREATED. OF COURSE, THE CBDT HAS TAKEN ITS DECISION AS PER THE POWERS AVAILABLE IN ITS HANDS & OR WITH THE PREVIOUS APPROVAL OF THE NEW B.J.P. GOVERNMENT.

Anybody can clarify whether the consequential posts on promotion to the post of ITO relating to vacancy year 2013-14 filled up during the F.Y.2014-15 comes under vacancy year 2013-14 or 2014-15.

As per model RR, service required for promotion from grade pay 4200 to 4600. But the concerned department can frame rules either increasing or decreasing the qualifying service. In our department as the candidates are screened by means of examination, their suitability for higher grade is tested and hence 3yrs has been recommended by the comittee. If new rule prescribed enhances the period and adversely affects the existing employees in a feeder cadre then suitable clause must be inserted in rr giving relief to the existing employees in the feeder cadre on the date of issue of new rule thereby protecting them from adverse effect.

The cadre restructure has been approved by the Department of expenditure and cabinet for the posts ETA, Inspector, ITO and so on. The draft recruitment rules have been framed in September 2009 for the post of inspector. since 1969, the recruitment rules for the posts of inspector was not changed even though the feeder cadres were changed into Sr.TA from UDC. In the previous recruitment rules upto 2000, the department is having feeder grades UDC. Once, the feeder cadre has been changed to Sr.TA then automatically the recruitment rules have to be changed by modifying the feeder cadre from UDC to Sr.TA. Now in the present restructure, the feeder cadre is only one ie ETA for the post of Inspector promotion. The cabinet has approved the CR posts intoto. Then how the DoPT approves the old recruitment rules. Why the CBDT or HRD has not sent for approval of the DoPT since 2009 even though the draft is kept ready for approval. What is the malafide intention behind it. How the HRD can take the old rules for the newly created manpower and how it could implement the new rules for the consequential posts. Totally contradictory. If any one file stay petition in Principle CAT Delhi against the HRD's letter saying that even after a lapse of 4 years, the draft rules are not approved then how for 2014-15 DPC the new rules will come within a couple of days and how it will apply for consequential posts. It clearly attributes the malafide intention to favor one set of people rather giving respect to the service seniority in the department since from the introduction and without getting approval from the DoPT.

The CBDT has not clarified one thing ie whether HRD is the supreme authority for the department in service matters like isue of seniority, promotion and other service rules or the CBDT is bound to follow the doPT approved instructions or recruitment rules. If the DoPT is the supreme, then why the draft recruitment rules were not sent to DoPT for approval since 2009. What is the hurdle with the department. is there any stay order on recruitment rules implementation. Why the CBDT always invites litigation in service matter. Because, they does not know the ground realities. Where is the justice for recognition of serving seniority. Why the recruitment rules of ITI from 1969 to till the last amendment was not published in the official gazette and why it was not circulated to all the CCIT(CCA). Except in the Incometax department, no where in other central government for giving special reservation to date of passing the examination. Is it there in the constitution or is it approved or is it in the recruitment rules. No. 100% it is not there. The present HRD instructions is in favor of stenos and at the same time is disfavor to the OS cadre since those OS cadre employees who wish to become AO, they are not getting because they have to wait for new rules ie after converting them into ETA and then only they have to write exam for AO post and after passing the said exam only, if vacancies are available for AO, then only the present eligible OSs will be promoted to AO. Is it justified in the present HRD letter. A group D employee can say that for AO post only ministerial cadre is eligible. Then why cannot give promotion to them with a relaxation if the vacancies in the cadre AO are clearly available. What is the hurdle with HRD for not giving approval now. Thus totally it is very much clear that HRD is favor to stenos and dis favor to the ministerial cadre despite the fact that SrTA are the pillars of the department.

date of passing is essential for hard working and meritorious employee in the IT deptt. to enhance their career. Honourable CBDT Jo bhi decision lete hain employee ki future keep liye best hota hai. Passing seniority should continue for those who wants to give extra hard work and time for the deptt for the sake of the country.

inter charge transferee are treated as slaves in the dept. even those who have not joined department r consider for seniority while those who r already working r being harrased by the CCA sorry Pr. CCIT now.

where is existing dopt rules & cbdt instruction not to count inter charge service for eligibilty if any body have please reply to this comment provide the copy of dopt rule & cbdt instruction which is mentioned in the HRD letter dated 28/05/14 for conducting dpc for ry 13-14

Only steno's need not complete 3 years in Grade-I and they can become inspector from Gr-III but not the STA's who have put in minimum 3 years in TA cadre. Good explanation of the recruitment rules. Rules should be uniform for everybody. I am bemused with comments of some people who are advising that Those who have not completed 3 years as STAs should not be promoted they are arguing in favour of the DRs who may join only in F.Y. 2018-19 and much beyond bcause of the merger of posts into EA and SCC has not notified for filing up EA posts in SSC CGLE 2014 they may do so only in CGLE 2015, further, SSC CGLE 2013 has been scrapped and a fresh examination is expected to be conducted simultaneously with CGLE2014 which may delay further.

THESE DELAYS DOES NOT MATTER NOW. THEIR SENIORITY IS SAME IN THE YEAR CORRESPONDING TO PROMOTION GIVEN TO PROMOTEES AND IN THE YEAR OF SENIORITY FIXED FOR PROMOTEES.
