Pr.CCIT BANGALORE ISSUES ITI & ITO PROMOTION ORDERS AND DISPOSES PARMAR ISSUE

Pr. CCIT, Bangalore yesterday issued promotions or ITI and ITOs and also disposed Parmar Issue by not implementing since 1986. He released a 10 page Memorandum explaining it can be implemented from 2012 only.

ATTEMPTS ARE BEING MADE BY SOME SECTIONS TO ISSUE MODIFIED INSTRUCTIONS BY THE BOARD

On 27th, the CBDT has issued Instructions for conducting DPCs for all Group-B and Group-C posts of CR and set uniform date of promotions as 5th June 2014. All the CCAs are in hurry to conduct DPCs before the dead line and issue the promotions orders on the day of Joy and Gladness i.e. 5th June 2014.

Though the major chunk of employees are delightful on the issue of Instrucions, a minor group of juniors are little disappointed with a clause. The Board clearly stated that the DPC for RY 2014-15 should be performed only after issue of new RRs. They are in worry because the fate of release of new/revised RRs is known only to the GOD as they are linked with the DOPT' approval and gazette notification. They are restrained from taking consequential posts since the consequential posts fall in the RY 2014-15.

So these people by hook or by cook, trying to give their best shot to exempt RY 2014-15 also from the perview of new/revised RRs.

Who is Arun Jaitly?

Arun Jaitley (born 28 December 1952) is currently the Minister of Finance and the Minister of Defence of the Union cabinet of India in the 16th Lok Sabha. He is a member of the Bharatiya Janata Party (BJP). He has also previously held the portfolios as the Union cabinet Minister for Commerce and IndustryLaw and Justice in the National Democratic Alliance government (1998-2004). In the2014 general election, he unsuccessfully contested as Bharatiya Janata Party's candidate for Amritsar, where he was defeated byIndian National Congress candidate, Captain Amarinder Singh.
Personal life : He was born to Maharaj Kishen Jaitley and Ratan Prabha Jaitley. Born into a Punjabi Hindu Brahmin family to a lawyer fatherhe studied at St. Xavier's School, New Delhi from 1957-69. He graduated in Commerce from Shri Ram College of Commerce, New Delhi in 1973. He passed his Law degree from the University of Delhi, in 1977. During his career as a student, he was the recipient of several distinctions for his outstanding performances both in academic and extra curricular activities. He was President of theStudents Union of Delhi University in 1974. Jaitley has been married to Sangeeta Jaitley since 24 May 1982. They have two children, a son named Rohan and a daughter named Sonali.

Will Jaitley be able to raise I-T exemption limit to Rs 5L?

Less than a month before the NDA won the elections with a thumping majority, Arun Jaitley had suggested that the Income Tax exemption limit should be raised to Rs 5 lakh from Rs 2 lakh currently.



There is no doubt that newly-appointed Finance Minister Arun Jaitley has a long list of problems to fix, inflation and fiscal deficit being the biggest headaches among them. There could also be a self-inflicted problem.


This is what he was quoted as saying in a Press Trust of India report dated April 21. Also Read: Jaitley the key man: Gets finance, defence & corp affairs "Direct Tax should be reduced. The Income-Tax limit has to be raised from Rs 2 lakh to Rs 5 lakh. The savings in the pockets of ordinary person by reducing ceiling on Income Tax will lead to increased purchase which in turn will lead to increased VAT and excise duty thereby increasing the revenue."


Now that he has become Finance Minister, Jaitley has a golden chance to convert his words into deeds and become a hero for the middle class. Interestingly, the BJP election manifesto of 2009 spoke about raising the I-T exemption limit to Rs 3 lakh, and an additional exemption of Rs 50,000 for women and senior citizens. 


The party's 2014 manifesto did not mention I-T exemption anywhere. Considering that less than 4 percent of the country's population pays personal income tax, raising the exemption limit could cost the new government a good chunk of direct tax revenues at a time when it is struggling to balance its books. 


In his election campaigns, Narendra Modi had repeatedly said that rationalizing taxes would be among the key priorities of his party if it were to come to power.


The July Budget may be too early for the government to introduce radical tax reforms. But given the high expectations that the industry and individuals have from Modi & Team, the Finance Minister will be counted upon to make a convincing start.

SPECULAITONS BECOME REALITY.. INSTRUCTIONS FOR RRs ISSUED BY THE BOARD


At last, as foreseen by this site, the CBDT has served stale food after cooking for 2 months. Today, the CBDT has issued an instructions wherein it stated 'draft rules can not form the basis of promoitions, when rules to the contrary are holding the field'.  We must 'congratulate' the CBDT for taking this 56 long days for inventingg this SC's observation.

So, as of now, there is no hurdle to CCsIT from the CBDT side to conduct DPCs for Gr-B & C posts.  It further stated that the instructions issued today will be applicable for Vacancy year 2013-14 and separate instruction will be issued for 2014-15.
The million dollor question is, what is the necessity to create new grade of EA, while giving promotions in the old pattern after getting approval of posts for new grade?


SPECULATION IS RIFE THAT EXISTING RRs FOR ITIs

There are some unconfirmed news that the existing RRs will be applied to the CR posts of ITIs. No official has confirmed this so far. With the efforts of some sections of employees, there are bright chances of applying old RRs for these posts atleast for RY 2013-14. All the regions are gearing up for release of ITI promotions with existing RRs.

CCIT DELHI RELEASES ITO PROMOTIONS WITH PARMAR IMPLEMENTATION

Delhi CCIT has became the first in ITD to release ITO promotions in the lines of NRP judgement. On Sunday 25th May 2014, the Pr.CCIT, New Delhi who has published Draft seniority list on 17th May, issued promotion order for 234 aspirants.

DELHI REGION RELEASES ITI PROMOTION FOR 194... INSTRUCTIONS FROM CBDT ON RR EXPECTED ON MONDAY

Pr. CCIT,  New Delhi released Order for Promotions to the cadre ITI. These are issued basing on the old RRs. Out of 194 names, there are only 10 OSs and Steno Gr-III, the remaining 184are from STA cadre. i.e all the OS and Stenos cadres are exhausted. And the another wonder in the order is the candidate who has joined as TA in 2006 also became ITI.

The list is subject change on receipt of new RRs or Parmar Implementation.
The instructions for Recruitment Rules for all Group-B and Group-C cadres are expected on Monday hopefully.

HATS OFF TO CCIT, KERALA.. SPLENDID AND LABORIOUS JOB

The Pr. CCIT, Kerala has done a great and applaudable task by making Revised seniority list for all the cadres since 1986, so that equitable justice reaching to all the employees. The Revised seniority lists are circulated yesterday. He stood as an ideal example to other CCsIT.  The Dynamic Kerala CCIT has performed a lenghthy and labourious job which is a legitimate demand of the largest section of the employees... i.e. ITEF & ITGOA.

The body of the covering letter is below:


1. Consequent to the issue of DOPTs OM dtd 4-3-2014, it has been decided to review the seniority position of officials of this Charge in compliance with the directions dated 27.11.2012of Hon'ble Supreme Court passed in Civil Appeal No.7414-7515 of 2005 in the case of N.R. Parmar & Others Vs. Union of India & Others.


2. Accordingly, the seniority list of ITI, UDC [erstwhile], Senior Tax Assistant and TA have been revised from 01.01.1986 onwards {or the date from which the post had come Into existence} on the basis of available records with this office and thereafter, their promotions to higher grades were given effect on the
basis of revised seniority position so arrived at. The revised seniority position prepared in draft in respect of the grades of ITO, ITI, STA and TA have been enclosed herewith.


3. You are requested to bring the position to the notice of all the officials In your office and the objections, If any, may be forwarded to this office within In two weeks from the date of receipt of this letter positively by 10th June, 2014 for consideration.


4. It Is further Informed that copies of entire records prepared for arriving at the seniority position are being forwarded to all the emaillds available with this office for the perusal of desirous officials.

PR. CCIT, NEW DELHI CIRCULATES DRAFT SENIORITY LIST OF ITI IN THE LINES OF NR PARMAR CASE

Yesterday, Principal CCIT, New Delhi, consequent to CAT order, has recasted the seniority list of ITIs. The ITIs of 2005 Notification are placed in the RY 2006-07 as recommended by the Committee constituted by the CCIT to examine and recommend the principle to recast the senirity of the appellant DR ITIs of 2005 Notificaiton. The committee after going through the CAT order which directed the CCIT to recast in the lines of N R Parmar judgement of the SC, has recommended that, as the requistion to the SSC in respec of vacancies was made in the RY 2006-07, they should be placed in the RY. Accordingly the Seniority is recasted for subsequent years also.

ITEF MUMBAI HEAVED A SIGH OF RELIEF ON DOPT's CLARIFICATION..... UPDATE ON RRs FOR ITIs & OTHERS

ITEF, Mumbai Circle expressed their happyness at DOPT's latese instruction dtd 1-5-2014 to the CBDT. The text posted in their site is reproduced below;

ITEF stand on interse seniority vindicated
               
 The ITEF stand on the implementation of OM of 1986 as per the Supreme Court judgment in the case of NR Parmar has been vindicated with the DOPT instruction to implement it in all the cadres in the department.
  
 The DOPT has unequivocally clarified that in the case of the Income tax department the entire issue of seniority of the officers of Income tax department would have to be revisited in compliance of the judgment of the Supreme Court.

UPDATE ON RECRUITMENT RULES FOR ITIs AND OTHER CADRES

Full Board in three sittings yesterday and day before yesterday, almost finalised the RRs for Group B and C executives. Instructions will be issued in a day or two. The ITEF, CHQrs are taking all efforts to expedite it.

CBDT TO ISSUE UNIFORM GUIDELINE FOR NR PARMAR CASE IMPLEMENTATION.. JCA REQUEST

In an affidavit submitted by the CBDT to the Supreme Court, against the appeal filed by some DR ITIs on the ground of Contempt of Court, the CBDT has assured SC the seniority of the officers are being re-fixed in the light of the recent Supreme Court order. The CBDT has submitted that a draft seniority list of officers since 1986 has been prepared and circulated to all the members inviting for objections if any from them.


On the other hand the ITGOA, as each CCIT is taking his own interpretation on the DOPT’s  OM dtd 4-3-2014, it has requested the CBDT, to issue uniform guidelines for implementation of the NR Parmar Judgment.


In this back ground the CBDT, has asked the DOPT and then the DOPT in its clarification dtd 1-5-2014, has confirmed that entire issue of seniority of the officers of the Income-tax Department would have to be revisited in compliance of the judgment of the Supreme Court.


Another interesting development is the Supreme Court in its order dtd 9-5-2014, disposing Contempt of Court Appeal filed by some DRs, has directed the Board to re-fix the seniroty of the officers within 4 weeks of time. Further the SC has stated ‘Needless to mention, that respondent no.1 and 2 (Chairman and CCA, Gujarat) shall be personally responsible, for ensuring compliance of the undertaking given to the above terms.  But the Board in its reply has talked about only for the Gujarat Charge.

Here the big question is the Board, which is the governing body for all the CCAs, can take different stand to different Regions? Certainly No.

Futher, the JCA in its letter dtd 20-05-2014 has requested CBDT, if any further instruction to the CCAs are being contemplated on the basis of the opinion now rendered by the DOPT, the “advisory”, referred to above, arrived by agreement by all stake holders may also be communicated to the CCAs for implementation of the Supreme Court judgement in a uniform manner in all the CCA Regions. 

So, friends, the Board is going to issue clear and uniform circular to all the CCAs for implementation for  all the cadres in all the regions to close the Pandora’s Box.

RRs NEWS FOR ITTs ..... PR.CCIT, BHOPAL RELEASED ITO PROMOTIONS YESTERDAY

As informed by this site yesterday, the Board has met yesterday and continued today. Two rounds of talks have taken place yesterday and today. The next rouund will continue post lunch today. As informed by the General Secretary, ITEF, CHQrs, New Delhi, today at 1.30 pm, the talks may become fruitful and ultimately result in issue of an Executive orders or ITI RRs. The decision may be taken in this after-noon session.

CCIT, ODISHA RELEASES ITO PROMOTIONS TODAY... CCIT, MP&CG TOMARROW......LOOK AT ITI RRs.

It is really high time in the IT Dept as so many aspirants are getting long awaited promotions.
Today CCIT, Odisha has released ITO promotions order with a list of 33 names (CR posts i.e RY 2013-14 : 28 posts and 5 for RY 2014-15.)
Also ITO promotions in MP & CG are in the pipe line. DPC conducted today. Tomarrow promotions are expected.

Now everybody's eyes on most prestegious and massive ITI promotions in the IT Dept all over India.

It is learnt that, the Board has met today, but there is no posiitve news in regard release of ITI RRs. The meeting will continue tomarrow.
The Board is expected to release the Executive Order for RRs of ITI and EA very soon.

Consequent to the Dynamic Chandigarh CCIT's  release of  ITI promotions, the cadre in all other regions mounting up lot of presure on the Associations and there by their Local Adminstrations.

CCIT CHANDIGARH RELEASED ITI PROMOTIONS - DOPT GIVEN CLARIFICATION TO CBDT ON PARMAR CASE IMPLEMENTATION

Let us congratulate CCIT(CCA), Chandigarh for releasing the ITI promotions from CR posts for RY 2013-14. The order passed on 16th May 2014 with list of 128 names. Interestingly, the order doesnt give any info about whether the promotions given basing on old RRs or new/proposed RRs. The conditions in the order includes the 'subject to the decision of CBDT/DOPT on the implementation
of supreme court decision, dated 27.7!.2012 in UOI Vs N.R.Parmar case or in view
of the representation on the issue of seniorlty of officials of any other cadre'.
The where abouts of the RRs for ITI are not known till now. Only rumours are taking rounds. There is no official and concrete news about them. The associations are least bothered in expediting it or giving actual status of the RRs. In fact, they also do not know the fate of the RRs. In some of the plotforms, employees are expressing their doubts regarding ITEF's interruption in the new RRs and trying to get modify RRs in favour of some smaller sections.

DOPT's CLARIFICATION ON PARMAR CASE IMPLEMENTATION
The DOPT in its reply to the CBDT, which has sought clarificaiton on interpretation of the provisions of DOPT OM dated 4-3-2014, It is stated that,
  •  it would not be feasible/desirablrt to give generalized opinon in respect of pending  court cases, as every case would have to be dealt with in its own context, while applying the provisions of laid down policy. However basing on the general observations of DOPTs OM dated 4-3-2014, the provisions of the OM dated 7.2.86/3.7.86  remain applicable till 27-11-2012. 
  • The cases of seniority which have been settled based on the available/implied interpretaton of OM dated 7.2.86/3.7.86 NEED NOT BE SUO MOTO REVISITED as it would unsettle the cadre dynamics.
  •  "IN THE SPECIFIC CONTEXT OF INCOME TAX DEPARTMENT, WHEREIN THE INTER-SE SENIORITY OF DIRECT RECRUITS AND PROMOTEES HAVE BEEN UNDER DISPUTE ON GROUNDS OF MIS-INTERPRETATION OF THE PROVISIONS OF THE OM DATED 7.2.86/3.7.86 AND HAS LED TO PARMAR JUDGEMENT OF SUPREME COURT, IT IS UNAMBIGUOUSLY CONFIRMED THAT THE INTIRE ISSUE OF SENIORITY OF THE OFFICERS OF INCOME TAX DEPARTMENT WOULD HAVE TO BE REVISTED IN COMPLIANCE OF THE JUDGEMENT OF THE SUPREME COURT."
So, friends, the DOPT is directing the CBDT to implement the Judgement ON THE REQUEST OF THE INDIVIDUAL in all the cadres since 1986. Indirectly the DOPT directing the CBDT not to ask for any further clarification. In every cases/depts involving court cases/judgements, it would have to be dealt with in its won context. It is implying the Revised instructions in  OM dtd 4-3-2014 are meant for general purpose to all other departmnents. It is enforcing the SC Judgcment in other departmetns atleast from 27-11-2012 if they are not following true sprit of the 1986 OM,  to avoid unwanted disturbance among cadre dynamics in other departments.

THREE CCITs ISSUED ITO PROMOTION ORDERS, ITEF DECLARS HELPLESSNESS IN UNIFORM DATE OF PROMOTION

Dear Comrades, 

it is known that Pr.CCsIT of Kanpur and Chennai have issued promotion order of ITOs 8th May 2014. Also it came to know that Pr CCIT, NWR has also released ITO promotions on 9th May 2014.
Surprisingly, ITEF has openly admitted their helplessness in bringing out uniform date of promotion all over India and alerted all the States to go on their own way. The States having no legal stay have proceeded to implement the CR promotions. But in some states like Kerala, AP, MP..etc where there are No Stay for promotions, the CCsIT are unable to issue promotion orders and they are functioning in their own lackadaisical style effecting badly the prospects of hundreds of employees of their region. May God help them know how to work in crucial times.


ANOTHER PITIFUL THING IS NEITHER OF ITEF/ITGOA/JCA/CBDT/DOPT ARE BOTHERED ABOUT THE RECRUITMENT RULES. NOBODY INTERESTED  SERIOUSLY IN THIS ISSUE AND  UPDATE THE ACTUAL STATUS OF THE RRs.

ALL EVERY ITO PROMOTIONS ORDERS OF ITOs THE CCsIT ARE INCLUDING THE CLAUSE OF 'SUBJECT TO CHANGE OF SENIORITY CONSEQUENT TO IMPEMENTATION OF PARMAR CASE AND OTHER CASES PENDING IN THEIR OWN STATES.

ITEF-ITGOA MEET AND ISSUES CIRCULAR


The National JCA met at Manishinath Bhawan as scheduled on 4th May 2014.

"All the members were in unison that the situation of apathy on the part of the CBDT cannot brook anymore and it is time to embark on serious agitation under the united platform of JCA. It is also noted that the intervention of the Secretary (Revenue) and his assurances need to be taken note of and some more time should be given to the RS to respond and decided to seek one more meeting with the Secretary (Revenue) at the earliest. It was also decided to write a letter to the Secretary (Revenue) highlighting 
some of the issues already taken up with him through our Memorandum with a request for his immediate interference to avoid industrial disturbances in the Department. Accordingly we sought a meeting with the Secretary (Revenue) at the earliest vide our letter dated 05.04.2014. 
i) Promotions to various cadres pending for more than a year and issuance of uniform 
instruction for implementing Supreme Court Order on inter-se-seniority. 
ii) Filling up of posts of ACIT created in CR 2013 at one go and creation of 
commensurate posts in the cadre of AO/PS 
iii) Fixation benefit on promotion and advance increment on passing Examination. 
iv) Amendment to IRS Recruitment Rules & framing of Transfer Policy. 
v) Reduction of existing strength on allocation of CR Posts. 
vi) Approval of schemes sanctioned from 1% incentive scheme."

The next meeting of the JCA will be held on 02.06.2014 at New Delhi. Necessary 
notice for the meeting alongwith agenda items will be issued shortly. The meeting 
further decided to draw the Charter of Demands and campaign amongst the members 
before embarking on any agitation. 
VII-CPC related matters: The meeting decided to submit a joint memorandum to 
the VII-Central Pay Commission on the issues of the personnel of the Department. A 
committee with three members each from ITEF & ITGOA has been formed with the 
following members to prepare the draft memorandum. 
Com. K.K.N. Kutty, Com. Ashok B Salunkhe and Com. K.P. Rajagopal from ITEF 
Com. Amitava Dey, Com. Arvind Trivedi and Com. J.B. Singh from ITGOA. 
It was also decided to circulate the draft memorandum amongst the circles/units for 
their suggestions and views. After consideration of the same final report will be 
prepared and submitted to the VII-CPC within the stipulated time
