RECOMMENDED NEW SCALES AND SALIENT FEATURES OF MEMO TO VII CPC SUBMITTED BY JCM(Staff Side)

National JCM has recommended fitment benifit ratio/multiplication factor of 3.7 times.

The National JCM (and also ITEF) recommended the follwoing corresponding sclaes in Group C cadres.

ITO: Rs. 78000

ITI : Rs. 74000

EA : Rs. 56000

TA : Rs. 46000 etc.


Salient features of Memorandum to VII_CPC submitted  by the National JCM on common issues.

Principles of Wage Determination:


Demanded need based minimum wage as per 15th ILC formula.  The intrinsic value of the assigned job at the intermediary level, the necessity to keep the relativity both at horizontal and vertical level and the need to provide a comparable salary for the top bureaucrats, taking into account the perks, privileges, benefits, allowances and concessions that go with the posts.  Thus the minimum pay to be assigned to the lowest level of Group C functionary in Government of India service at Rs. 26,000/-.


Pay Band & Grade Pay:Staff side decided to demand reversal of the PB & GP System to distinct pay scale system.


Highest SalaryIt is suggested that this ratio should be 1 : 8.


Proposed Pay StructureAnnexed separately.


Rate of IncrementDemanded the rate of annual increment at 5%.


Fitment FormulaDemanded a uniform multiplication factor (26000/ 7000 = 3.7) to be applied uniformly in all the cases to arrive at the revised pay in the new scale of pay. 


Fixation of Pay on promotionThe benefit on promotion should be “Two increments in the feeder cadre with a stipulation that the amount of benefit so arrived at must not be less than the difference of the minimum of the scale of pay of the feeder cadre and the minimum of the scale of the cadre to which one is promoted


Date of effect.1. To implement the recommendations of VII CPC with effect from 1.1.2014 especially in the background that the desirable tenure of the earlier Commission’s recommendations expired on 1.1.2011.2. To merge DA and treat the same as pay for all purposes and ad when the DA entitlement reaches 50%3. To set up the next wage revision body or Pay Commission sufficiently before the expiry of five years.


Dearness allowance.The existing formula of computation of DA and its payment with effect from 1st January, and 1st July, may continue. 


House Rent allowance.

BOARD MATTERS...... JUST RELAX...

There is a mutaion in the Board's attitude in the recent times..It seems itz outdoing the old system. Is this is the result of New Gevermnent ?

In a recent letter, the Board has expressed its displeasure in the 'personal' visits of certain officers to the CBDT, New Delhi on superficial grounds. It observed that certain officers are visiting CBDT personally only for submitting the proposals to the Board and that too without any prior intimation. The officers were conveyed that such visits not only result in wastage of
time of officers but also lead to undesirable expenditure incurred on tour. 'It is
reiterated that the proposals and the requisite information may strictly be sent by post
and the soft copy of the same may also be sent by e-mail. At present, there is no need
for personal visits' ........ the Board is outmatching itself...... a good development.


Video Conference on 26th June at 3.30 PM on Systems Related Issues.
The Department is replacing the IBM by TCS for Data Sevices Contract for transiton of the Hardward of Data Centre. The conference is to facilitate the users of tha Applicaiton on various issues surfacing from the new Migration.


ITI promotions in Mumbai Region.
Mumbai Pr CCIT issued promotions to the post of ITIs for 378 eligible candidates on 20th June. Earlier the Pr.CCIT circulated the Draft eligibility list on 20-5-2014 and a revised list on 16-6-2014. We congratulate all the promoted officials.

CBDT FEELS THE HEAT

During the previous week, couple of incidents caused the Chairman, CBDT big irritation. When he visited Hyderabad on 6th June to hold DPC to the post of CIT, he expressed his displeasure over the service litigations being filed in various regions especially AP, Karnataka. He came to know during his visit Hyd, the CAT, Hyd has stalled the DPC till 5th June. In a weeks time one OA(original Appln) and three MA (Misc. appln/pitition) were filed. Two oral directions and two orders on MA petitions were passed by the active CAT in span of 4 days.


The, CAT, Bangalore directed the CCA, Bangalore to give ITO promotions in the line of NR Parmar Judegement and order the CCA to revert back the ITO Promotions Earlier in the last month (before the  receipt of Board letter dtd 6th June 2014, ordering all CCAs to implement the NRP in all cadres since 1986) vide his 10 page Memo dtd 30-5-14 the CCA rejected the plea of DR ITIs, meaning not implmenting the NRP.

In Hyderabad, a group of employees (13) were filed one OA and one MA and challenging the propsed DPC for ITI which was being conducted on old and existing RRs as directed by the Board vide its direction dtd 27-5-2014. The petitioners relied on the Board's earlier letter dtd 31-5-2013, which, in the opinion of the petitioners, states that the the Cabinet has permitted to promotions should be given on one time relaxation with new Model Recruitment Rules. This was mentioned in the letter in a para after discussing the posts of ACITs in earlier para. Again in the next para it said about the HAG+ scales of CCITs. This was key letter for the petioners and they imply the meaining to all the Group B and Group C posts. In the last but one para of the letter it was stated that 'region/state wise allocaitons of post will be intimated separately., and again in the last para it was stated 'approval of the Cabinet conveyed by Cabinet Secretary vide its Note no. 20/CM/2013(i) dtd 27th May 2013.
The petitioners contends that the Board's letter dtd 27-5-2013 implies that the promotions shoud be given on model recruitment rules (which indirectly says merger of OS/STA/Steno-I cadres).

But is it actually mean what the petitioners mean ?


In the letter dtd 27-5-2014, the Board stated the matter was conveyed by the Cabinet Note dated 27-5-2013. So the bone of content is exists in the Cabinet Note no. 20/CM/2013(i) dtd 27th May 2013.As seen from the Note (available in the later part), the entire note of the Cabinet (34 pages) which includes the minutes of the meetings Cabinet/Cadre eview Committee under Chairmanship of Cabinet Secretaryhc, the entire note was discussed for ACIT and above posts only. The RRs for ACIT/JCT was discussed at Page 21 of  36. There was only a mention of Group B & C posts at Page 19 of 34 ' increase in Group A posts will require consequential increase in Group B and Group C posts, which would be as per norms in this regard:
So it is clear that in the entire of Note of 34 pages, no where the Cabinet was discussed about the manner of recruitment of Group B and C. It all discussed in lengh about all Group A posts only.

What is the use of crying when the birds ate the whole farm?

The examination of Paper IV of ITO DE 2014 to be reconducted on 18th July 2014.  The exam is being reconducted after allegation of paper leakage earlier in this month. This time the Board directed the CCAs to appoint 3 Speical Observers at each centre and also the name of such observers are to be conveyed to the Board immidiately. 

What is the use of crying when the birds ate the whole farm?

There are so many allegations in all the regions regarding the way the examinations are being conducted.

The administration should know that undeserved promotion to an incompetent employee will not only hamper the work but also harms the competent ones.

Let us hope atleast now onwards, the Board will act sincere and smart.

CENTRAL JCA CIRCULAR ON 11 POINT CHARTER OF DEMAND

The Central JCA, in its meeting held on 02-06-2014 at New Delhi thread-barely discussed the issues/ problems remaining unresolved at the apex level for a long time and it appears that no sincere or discernible efforts have been taken by the Board to resolve these issues. The meeting further took stock of the situation in view of such long pending issues and rising resentment among the rank and file of its members. The meeting, therefore, chalked out an 11-point charter of demands concerning the welfare and career of its members for their immediate settlement by the Board to avoid any future industrial unrest in the Department. The said charter of demand is enclosed with this letter with the expectation that the Chairman, will sincerely address the issues on a priority basis within a reasonable period of time so as to avoid unpleasant situation in the department.

GREATEST NEWS... CBDT ISSUED UNIFORM GUIDELINES ON NRP

CBDT HAS ISSUED A UNIFORM AND UNAMBIGUOUS INSTRUCTIONS TO ALL CCA THROUGH ITS LETTER DATED 6TH JUNE 2014. THE CBDT IN THE LETTER, CLARIFIED THAT THE ISSUE OF INTER-SE SERNIORITY IN THE INCOMETAX DEPARTMENT IS UNSETTLED. SO THE ENTIRE SENIORITY OF THE OF THE OFFICERS OF THE INCOMETAX DEPARTMENT IS TO BE REFIXED.

LET US HOPE ALL THE AGONIES AMONG THE OFFICERS/STAFF OF THE DEPARTMENT WILL GO AWAY. BEST OF LUCK.

KERALA CHARGE RELEASED ITO,ITI AND OTHER CADRES PROMOTIONS

Yesterday Pr. CCIT, Kerala released promotions for 22 ITOs, 65 ITIs and other cadres also. That is the only charge smothly and amicably giving all the promotions without any litigations. In all the orders a condition is laid down 'promotions of the above officials are likely to be reviewed upon finalizing the draft seiniority positons of various grades circulated vide this office letter in FNo... dated 22.5-.2014 in compliance with NR Parmar case..
All the promoitons are effected on 5th June 2014 as directed by the Board.

GUJARAT AND MUMBAI BECAME FIRST TO RELEASE ITO PROMOTION ORDER ON NRP LINE

GUJARAT:

Yesterday Pr.CCIT, Gujarat releaed ITO prmotions orders. Two promotion orders for ITOs one is Reviewed list of ITO with 56 name and another is Supplimentary list of ITOs with 106 names. And it is stated the seniroty is subject to change due to refixation of seniority of lower cadres from 1986.

MUMBAI:

Today Pr. CCIT, Mumbai, today released ITO promotions order. The list contains 237 names for RY: 2013-14. All these promotions are released after circualating the seniority list as per NRP in the ITI cadre and alter disposing all the pending objections.

It is known fact that NRP implementation since 1986 is on the way in vaious other regions viz. Delhi, Kerala, Rajasthan, Nagpur etc.

We must express our deep sense of appreciaiton to the viewers of this site for their overwhelming support and exposing their commets/views but in different moods...
Dear friends, it is observed from the response comments of the viewers, most of them are frustrated with either one or some of the reasons like delay in getting promotions, or not getteing elevated becaue different stand/view taken by the administration, depriving of right of the right of the employee or entangled in legal stays. 
There are so many issues and malfuctions taking place every where in the department. 
Can the root couse for all these problems can be attributed to any single body ?
Is it CBDT for not issuing concrete and uniform guidelines or not isseuing detailed unambiguas instruction in any matter or not taking the timely action/decision ?
Or is it the DOPT who governs all the service rules ?
Is it the local adminstration taking their own and independent view even differing to his counterpart for their convenience and 'safe stategey' ? or lack of its dynamism ?
Is it the individual employee who is lacking in personality imbalance or miscalculation about their future ?

One implementing the case perfectly in line with the judgement and other Not being inactive and boldly supporting his action by issuing a ten page memorandum explaining how the case could not be. Here the common thing is both were active and dynamic. Both interpreted in their way and taken a concrete action instead of dilly dallying the matter. In the absence of concrete and clear and unambiguous guidelines or directions from CBDT, they proceeded to their own and well supported their action instead of being in inaction. They have summarily rejected or accepted the NRP view in the absence of a guiding uniform rule.)
