Congratulations to all the members. It is a confirmed news that the CR filed approved by the FM. The Notification is expected today itself.

Waiting gives our minds time to wander off track, and it can generally lead to scattered thoughts, fears, negative self talk and other such related things. Most of the time it can lead to us feeling anxious, scared, worried, and sometimes depressed. I have trouble with this a lot myself, and for me,the best coping strategy I have come up with is deep breathing and affirmations. Different things work for different people though. But taking your mind out of the moment, and doing something to calm your body can go a long way in such situations. Whether it be music, affirmation, other distraction techniques. There are a lot of things you can try to help get you through tough situations like that. And at first understandably you may have trouble remembering to do these things in the moment of hightened anxiety, but the more you practice something that works for you, the more natural it will seem, and it will be a natural reaction to help you keep yourself calm, and collected. Hope this was sort of helpful.Just speaking from experience and hope it can help you through some of those tough moments.

The Notification is under way. It may strike at any time today.

BREAKING BREAKING..... GOOD NEWS TO ALL

Hi friends,

It is great news that the Principal CCsIT promotion, the cadre linked with the Cadre Restruture is released today. The order dated 27th March 2014 has 18 names. These are going to be CCAs. The names lists starts with Mr. M K Mirani and ends with Mr. S Ravi. The fourth name in the list of Principal CCsIT i.e.  Out of these Pr.CCsIT, two at SNo. 4 &5 i.e. Mr. T K Shah & R K Rai are going to retire on 31st Mar 2014. The next names in the seniority list are Mr. B Dutta and Mr.Amitabh Misra. These two will become Pr.CCsIT w.e.f. 1-4-2014.
This confirms that the Cadre Restrucuture proposal is approved or very near to approval and the Notificaiton is going to be released very very soon. It is confirmed by the ITEF CHQ on 26th March, the Notiification will be released by 31st March 2014 by all probaliities.

The Chairman and the Members, CBDT in a latest message congratulated them on their elevation to the cadre of Principal CCsIT i.e. to the apex scale of Rs. 80000/-. The Chairman stated its an historical day in the history of the Incometax Departemnt.

MEMBER (P&V) INFORMS IN WRITING ABOUT MEETING WITH REVENUE SECRETARY & ITGOA VIEW ON NR PARMAR ISSUE

After the announcement of agitational program on the matter of implementation of Cadre Restructuring of Income Tax Department, now the JCA Delhi has decided to withhold the agitation starting from 19.3.2014 till further information.As per the information gathered, the Member (P & V), CBDT has called the ITEF, Delhi Circle to meet and discuss the matter on 18.3.2013. In the meeting she has intimated that official meeting with the Secretary (Revenue) has been fixed for 19.3.2014 and assured that the Board is making all out efforts to expedite the implementation of the Cadre Restructuring and requested to postpone the agitation till the outcome of the said presentation with the Revenue Secretary. It is also informed that the assurance given by the Member (P & V), CBDT is conveyed in writing to the ITEF, Delhi Circle through the office of the CCIT (CCA), New Delhi.

ITGOA writes letter to CBDT on NR Parmar issue.
............. In our view, in states where seniority in the cadres of Inspectorshave been fixed overlooking the principles laid down vide DOPT O.M.dated 070.2.1986/03.07.1986 or with some aberrations or with otherwiseinterpretation and / or which has been challenged , will be consideredas unsettled seniority list and needs to be revised accordingly inpursuance of Para 5(i) of the DOPT's aforementioned O.M. for settlingthe same afresh. Further, since the DOPT OM dated 03.03.2008 has been treated as non-existent/ withdrawn ab initio, the seniority fixed under that OM needs to be re-fixed as per the latest OM dated 04.03.2014. It is therefore requested to kindly issue clarification as to in which cases the seniority is to be settled as per latest O.M...........

In view of above narrated facts, we would like to request your honourto kindly issue proper guidelines/ clarification for its uniformimplementation as stated above. There is urgent need to attend thisproblem as the promotions in all cadres are stayed by judicialauthorities, which is jeopardizing the career prospects of themembers of this esteemed Association. "

ITGOA's letter dated 14th March and CBDT letter is dated 15th March 2014. So, can it be expected that the Priciples laid down in the OM dated 4-3-2014 are to be implemented even for the cases of prior 2012 ?

CBDT FORWARDS THE DOPT OM FOR FIXATION OF INTER-SE-SENIORITY & A WATCH OUT AT NEW DELHI CIRCLE.

On Friday CBDT has issued a letter to all CsCIT(CCA) referring the Supreme Court Judgement in the case of NR Parmar and DOPT's OM dated 3rd March 2014 and directed all the CsCIT to refix the inter-se-senerioty of PRs and DRs. It is also stating the immediate necessary action should be taken in accordance with the DOPTs OM.
Surprisingly, CBDTs letter is marked as MOST URGENT AND COURT MATTER. After 15 months since the date of Judgement, they have identified the Order as most urgent.
The only additional thing it has expressed in the the letter is that it has stated that the guidelines issued in the OM are Consolidated guidelines ( i.e. not the Amended Guide lines.)

In fact all the ITians are eagerly waiting for a clarification from the CBDT, in the view of the latest OM of DOPT, whether it is to be implemented from 1986 or from 2012.There are varied views from the latest OM of the DOPT.
In a Circular of the ITGOA (new Body) issued earlier in this month, that the Board has assured them of uniform implementation of the Judgement. In its letter is it mean the same?

NEW DELHI CIRCLE:
It is leant that the CCIT(CCA), New Delhi has issued a letter to all the CCs/DGs in his jurisdiction asking them to get ready all the vigilance clearances ready by 20th March for promotions in Group B and C cadres anticipating the likely additional posts from the CR. It has issued two separate letters in the last week for ITOs and ITIs. Interestingly, the ITEF, New Delhi circle decided to go agitation programme, starting from 19th March, if the Notification for allocation of posts by the CBDT was not issued by that date.

CR UPDATES

It is learnt from the reliable sources and from the close associates of Ministry of Finance, that the CR file is vetted by the Fianance Minister and the same is returned to the CBDT for further action. The source is of the news, independent to any other site. Next process of implementation, i.e. issue of Notification is expected in a week's time. This can be treaed as almost confirmed news but not 100 percent, since, it is to be officially confirmed by the CBDT only.

DEVELOPMENTS ON NR PARMAR ISSUE & IMPLEMENTATION

It is learnt that the newly elected body of ITGOA has met the DG/DIRT(HRD) and MEMBER(P) in this week. They intimated the developments on various issues like ITO2AC promotions, IRS Recruitments rules and implementation of Judgement in NR Parmar case etc. The matter relevant to the most fiery issue i.e. NR Parmar is as under: 

 Issue of uniform guidelines on implementation of the Hon’ble Supreme Court judgement in N R Parmar case

 The CHQ was informed by the HRD on 04/03/2014 that as per the advice of the DOPT, the Department of Legal Affairs (DOLA) was requested to extend their advice on this issue. While the CHQ was discussing the matter with the DIT(HRD)-II, the advice of DOLA was received. We then requested the DIT(HRD)-II for immediate issuance of uniform guidelines to all the CCsIT. He assured to do the same within 7 days. In the meantime, in the evening of 04/03/2014, it came to the notice that the DOPT has issued its OM dated 04/03/2014 formulating the modalities for fixation of the inter-se-seniority between the direct recruits and promotes. The issue was discussed with the Member(P) on 05/03/2014 and she was requested to issue uniform guidelines on implementation of the  Hon’ble Supreme Court judgement in N R Parmar case taking into account the advice of DOLA and the OM of the DOPT to remove all doubts forever. We also requested for a time bound implementation of the matter so that the overdue promotions can be given effect early. The Member(P) assured that the necessary instructions will be issued to the officials concerned.

CONTRASTING PRINCPLES OF DOPT - ISSUES ANOTHER OM ON SC JUDGEMENT IN PARMAR CASE

Again the DOPT is withdrawing the OM issued in 2008 on interse seniority and resorting to 1986 OMs. On one side  it is contemplating the SC's Judgement and reiterating the true meaning of the 1986 OM in the same lines interpreted by the SC, but on the other side it is ruling this could be effective only from Nov 2012 i.e. date of Judgement. One could wonder, how a OM issued in 1986 is effective only from Nov 2012.  Also, it is stating that the for the people for whom the matter is settled in the lines of 1986 OM/SC Judgement, can not be reopened.
What do you call this standard of the DOPT?
Can an OM issued some 30 years ago can be implemented prospectively from 2012 only ?
God only knows.
