PARMAR JUDGEMENT ROLES OUT IN ALL THE STATES

The Adminstrations of all the Regions across ITD-INDIA are gradually implementing the NR Parmar Judgement retrospectively and not from the date of Supreme Court Judgement. They are following the D.O.P. & T., Government of India, New Delhi's O.M.No.2201 1/1 /2012 Estt. (D) dated 04/03/2014, in addition to directions contained in CBDT's F.No. HRD/CM /220/14/2013-14/153/2014- Ad VII dated 13.03.2014.
The Pr.CCIT Mumbai has revised the seniority and circulated it on 12-4-2014 and the Pr.CCIT, Gujarat has prepared the Seniority list of ITIs in consultation with all the stake holders, in the lines of above correspondences, retrospectively w.e.f. 1-3-1986. It is worth here to mention, he is going to implement it for lower cadre also sincerely. For the lower cadres it is under progress. Thus effect of implementation of the  latest OM is minimised by implementing for all the cadres.
So friends, Justice may be delayed but cant be denied to anybody.
THUS EQUAL JUSTICE TO ALL IS PREVAILED.

Recruitment Rules for ITIs and EAs

The Recruitment Rules for ITI and EA cadres are expected to be released tomarrow. It is came to know that the RRs are pending approval at DOPT. The CBDT is about release the Ad-hoc RRs for these cadres to facilitate the administrative exigencies.

NR Parmar updates...

As per the news in the air so far, the number of vacancies reported in the CGL 2005 pertaining to the RY 2005-06 is only 5 vacancies. The same is even considered in the submissions given by the Promotee parties before the High Court of AP.

How ever the facts are like this......

As a matter of Government policy, there is a ban on recruitment of ITIs and other posts. But in the year 2006, the ban was lifted and the vacancies arised in the past years were started filling up. So the CBDT has made requisition  for 58 posts pertaining 2001-02 in the month of December 2006 and another 759 vacancies pertaining to 2002-03 to 2005-06 for the consideration of CGL 2005 notification. The final requisition for the total posts of 817 was made vide its letter F.No.OA-12021/3/2006-Ad VII dtd 20.02.07. 

The above facts are considered and confirmed by the CCIT(CCA), Mumbai.

Another flash news is the Mumbai CCIT has rightly interpreted the true meaning of Parmar Case Judgement and DOPT OM dated 4-3-2014. Thus for all the 817 posts, the seniority would be considered in the RY 2006-07. The seniority of the DRs as said in the Apex court judgement was considered even to the SSC Notifications prior to 27-11-2012. The CCIT has prepared the Revised seniority lists of ITIs considering in the same lines for CGL 2006,2008,2010 also as under:

The CCIT has circulated the revised seniority list and he directed all the existing ITIs to submit their objections/discrepancies, if any, latest by 30-4-2014.

Interestingly the Direct Recruit UDCs also getting ready for implementation of NR Parmar judgement for their cadre to compensate the loss for them. In some of the States, they have already filed representations and in other states, they are preparing for filing petitions before Courts.

Procedural fairness is part of our cultural heritage. It is deeply rooted in our law. It lies at the heart of the judicial function and conditions the exercise of a large array of administrative powers affecting the rights, duties, privileges and immunities of individuals and organisations.

When we look in to the history, the legendary personalities of West Bengal have glorified the name of their homeland as well as the Nation. Be it science, religion, politics, music, dance, leterature, films or any field, the Bengalies have excelled without any limitation. Many stalwarts from the Nation like Swami Vivekananda, Rama Krishna, Aurobindo Gosh, Tagore, Bose are from the land of West Bengal. The entire Nation has a special reverance towards Bengalies.

In one of its latest posts of a well known simple blog it is stating "..........It is really an irony of fate that when WB JCA is on agitation demanding more posts for their region, CBDT is taking away posts from this already deprived region." In most of the earlier occations the simple blog authors who are apparantly hailed from WB showing vested interests towards their region.

The demands of the WB region appears to be genuine for them selves but they should try to continue the legacy to some extent. The principle of natural justice will apply to all the fellow employees of the Income tax Department. In all the cadres there is huge stagnation. The officials from West Bengal should open up their minds and should have broad views. So far, since 2001, they have enjoyed the promotions like none other region in the entire Nation. Now, the time has come to cease this inequality and should come forward to accept the ground reality.

CR UPDATES:As informed earleir in this blog, A kick-off conference to discuss the " Cadre Restructuring Plan: Scheme for Distribution of Posts" is going to be held on 15th April at 11.00 AM at New Delhi. All the concerned Addl.CIT(HQrs) and Chairman, Local Imlementation Committee are directed to attend the meeting along with draft jurisdiction proposals for discussion.

CADRE RESTRUCTURE - VIDEO CONFERENCE - HIGHLIGHTS

Some of the high lights of the Video Conference with regard to Cadre restructure among other items are as under:

• Chairman Mr. R K Tewari congratulated all the members of the ITD and the Member(IT) Mrs. Anita Kapur has appraised the CR committee members for successfull completion of their task.
• The Chairman has confirmed that for promotions the CCIT, Principal CIT and CIT, it is requested the UPSC to conduct the DPC and sooner the date of DPC will be announced by the UPSC. 
• Member(IT) has shown the booklet containing the norms of the CR which contains the detailed Charge wise allocaiton of posts and other matters.
• Member(A&J) demonstrated the Road map of the CR implementation. Most of the points uttered by the Member are inaudible and some of the points are the Region-wise allocation will be forwarded to all CCAs this week itself.
• Requested all the CCAs to conduct the DPCs soon after the receipt of the Norms.
• New offices in the districts should be finalised with in 10 to 15 days.
• Addl.CIT(Admn)s will be consulted and Jurisdictions and Infracture matters will be finalised on 15th April.
• One of the CCIT has requested for the uniform date of DPC should be followed and the Chairman assuered the same. Then CCIT, Mumbai informed his inability to conduct DPC for ITO as there is a stay granted by CAT.
