BOARD ISSUES GUIDELINES FOR CONDUCTING DPCs

GREAT NEWS.... CONGRATULATIONS TO ALL THE ASPIRANTS..

               Yesterday CBDT issued instruction regarding conducting DPCs for all existing vacancies in Group B & C posts. It clarified that the new RRs yet to be accorded DOPT clearance, CCITs may go ahead with existing recruitment rules for promotion to the post of Gr B & Gr C categories."For the 'Executive Assistant(EA) grade. which has been approved to be created by merger of the grades of OS, Sr. TA & Steno Gr.I, the new Recruitment Rules for Executive Assistant cadre is also not yet notified. 

                   It is further clarified that current Recruitment Rules for the grades of OS. Sr. TA & Steno (Gr. I (which would merge into the single cadre of Executive Assistant upon notification of the Recruitment Rules for the latter) may be utilized by DPCs. In other words. DPCs for promotion of Sr TA to OS. TA to.Sr TA & Steno Gr II (erstwhile Steno Grade III) to Steno Gr. I are to be conducted. For the limited purpose of quantifying vacancies for conducting DPCs, the number of posts notified for the EA grade may be further trifurcated in each CCA region among OS/Sr. TA/Steno Gr. I, in the same ratio as thepre-restructuring number of sanctioned posts in these grades.  The DPCs will be conducted by 21.12.2014 in all cadre controlling Regions.

ITEF CHQ CIRCULAR ON VARIOUS ISSUES

Filling up of Post of RY 2014-15.
The JCA leaders Coms. Ashok B Salunkhe, KP Rajagopal (President & Secy Genl, ITEF) Coms. Ajay Goyal, Bhaskar Bhattacharya & Aravind Trivedi (President, Secy Genl & Addl. Secy.- ITGOA) had a meeting with the Chairperson Ms. Anita Kapur and Member (P) Shri A.K. Jain on the above issue and RRs of IRS Officers.   On the basis of imputs that the DoPT may require more time to consider and approve the RRs of various cadres in the Department and the rider attached to the instant instructions on the matter, it was decided to go with the existing Recruitment Rules for all the cadres for filling up of vacancies for the Rect. Year 2014-15.  It was also decided to move separately to the Competent Authorities to get relaxation for filling up the posts in the Inspectors cadre lying vacant for want of candidates in one of the two categories by considering the candidates in the other category.   The instructions for holding DPC meetings and effecting promotions on the above lines will be issued shortly.
Provision of Air Conditioners.
We have been informed by the Board that the Dept of Expenditure has, after a long time, finally approved the proposal for 6 air conditioners per range for staff rooms.  The allocation of fund to the identified Ranges are under way and orders to this effect will be issued soon.
Laptops to ITIs & Mobile handsets to all.
We have also been informed that the IFU (Dept. Of Revenue) after returning the files quite a number of times for clarification etc. has finally approved the two proposals viz. Laptops to Inspectors and Mobile Handsets to all personnel out of the 1% incentive fund.  These proposals have been submitted to the Department of Expenditure for  Govt.’s final approval.
Deptl. Examination Results.
The Results of Departmental Examination for Income Tax Officers have been declared and published.  The declaration of results of the Departmental Examination for Inspectors is likely to be delayed till December, 2014 due to some technical problem in the answer papers of Delhi Region. 
National Convention of CG Employees.
The National Conventiuon of organisations of JCM Staff side, as intimated, will be held on 11.12.2014 from 12noon to 4PM at MPCU Shah Auditorium, Civil Lines, New Delhi.  The Secretariat of ITEF is scheduled to meet on 10.12.2014 and all the Sect. members are to attend the above convention.  Therefore, the Secretariat Members may come prepared to stay at Delhi on 10.12.2014.
Confederation TUE Camp.
The next All India Trade Union Education Camp of Confederation is scheduled to be held at Bangalore on 5th and 6th January, 2015.  Our organisation has been given a quota of 20 delegates.  Therefore all the Secretariat Members are requested to attend the camp during  the two days.  In case any Sect. Member(s) are not able to make it, the same may be intimated to the CHQ for nominating other comrades as delegates from ITEF.  The CHQ is requesting the ITEF Karnataka & Goa Circle to make arrangements for the stay etc. of the ITEF Delegates.  The Confederation Circular No. No. 51 is enclosed for further details on the subject.

VARIOUS NOTIFICATIONS AND GUIDE LINES ON RESTRUCTURING

The Board has issued Notifications for Territorial juricdiction orders of IT&TP, Exemptions and TDS charges. Also the board consequent to the Video conference on 10th Nov 2014, issued certain guide lines relating to operationalization of  new jurisdictions. The Board will issue orders today or tomarrow giving additional charge of Pr.CCITs to the existing CCIT(CCA)s w.e.f. 15-11-2014. Also it is directed all the Pr.CCITs/CCITs should pass the administrative orders for assigning charge/additional charge for all new posts shall be passed by 13th November w.e.f. 15-11-2014 and there after, the new incumbents shall issue the jurisdiction orders  on 15.11.2014.

CBDT ISSUES MOST AWAITED REVISED ADVISORY ON NRPARMAR CASE

NRP WOULD BE IMPLEMENTED FOR ALL CADRES


Today the Board has issued a Revised Advisory in a FAQ format for uniform implementation of the revision of seniority lists in all Regions in the Country, in supersession of the FAQ's issued vide F. No. HRD/CM/220/14/ 2013-14.4275 dated 29th September, 2014. 


Also the the Board has directed to complete the exercise of implementation of NR Parmar Judgment and conducting of review DPCs may be completed latest by 24 th November 2014. 


The only one answer for which the JCA has objected earlier is now revised by the Board aftter clarification from the DOPT. Now the NR Parmar issue is applicable to the cadre of earstwhile UDCs and TAs also. It is deemed meaning that the NRP is also implemented in the cadre of Stenos and LDCs as these were the basic cadres of direct recruitment by the SSC.

BREAKING NEWS.......GAZETTE NOTIFICATION PUBLISSHED FOR ALL CITs

Today the Gazette notifications for all the four orders dated 22nd October 2014 were published in the Gazette of India. The four notifications consists of 398 pages (Hindi&English).


The four orders are,
1. Pr.CCIT/CCITs jurisdiction
2. Pr.CIT/CITs jurisdiction
3. CCIT(Exemptions) jurisdiction
4. Pr.CCIT/CCIT(Intl Taxn) jurisdicitons.


With this the role of at the Board level regarding jurisdiction is completed. Now only the Pr.CIT/CIT have pass their individual Notification for their Ranges/Circles/Wards.
All these orders/notifications are being done with effeictive date of 15th November 2014.

NOTIFICATION FOR PR.CCIT/CCITs RELEASED WITH EFFECITVE DATE OF 15TH NOV.

The Board has passed the order U/s. 120 on 22nd October 2014 specifying the jurisdiction of Pr.CCIT/CCITs of all the regions. In the order it is stated the effective date of notification would be 15th November 2014. Also it is expected the notification by the Board with jurisdictions of all the CITs ( which consists of 750 pages) are expected in a week and the respective CITs will pass Notification U/s.120 classifying the jurisdiction of his charge Ranges and circles/wards with effective date of 15th November 2014.

EFFECTIVE DATE ANNOUNCED AS 15TH NOVEMBER 2014

It is learnt the Board has issued a communication to all the CCAs regarding notification of jurisdiction after getting approval from Ministry of Law in the last week. In the letter it is stated the effective date of notificaion in all the regions should be 15th November 2014. Alos it has intimated the Gazette notification number of the notification. It is expected that the notificaiton by the Board with jurisctions of all the CITs in the country  are expected in a week and the respective CITs will pass Notificaito U/s.120 classifying the jurisdiction of his charge Ranges and circles/wards with effective date of 15th November 2014.

JURISDICTION NOTIFICATION SOON

The half baked CR implementatin likely to pass through one more crucial stage of Release of gazette notificaiton for jurisdiciton. It came to know that the draft jurisdiction was approved by the Board. Earlier it was sent for approval of DoLA, they raised some querries, and were complied by the Board after consulting the CCAs.


Now, the release of notification is inevitable. Even some of the charges like Mumbai and Bangalore etc wished to postphone the Notificaiton on some administrative grounds, the Board is inclined to release it and anticipating to gain fruits of CR in this year itself atleast to some extent. As the promotions were already effected in Pr CCIT cadre and in all Group B and C cadres though with excetptions of consenquetial promotions, the Board is keen in completing the Notification process this year itself. The notification exp ected to release in the month of November 2014 with effective date of 1st or 15th November 2014.


Another major event that is going to take place in a couple days which may have impact on effective date of notificaiton, is retirement of our Hon'ble Chairman, CBDT. Mr. KV Chowdhary, the present Chairman is going retire on 31st Oct. It is expected to extend the same Chairman for another 3 months. It is also came to know that he is going to CVC for 2 years term, if it is so, he has to resign to the present post two days before retirement. The matters of Notification and appointment of Chairman are expected finalisation in a couple of days.

BOARD RELEASES CORREGENDUM ON SCHEME OF DISTRIBUTION OF POSTS

The CBDT today isssued a corregendum to the Pr.DGIT(HRD)s DO letter dtd 4-4-2014 regarding scheme of distributiohn posts under CR plan of IT dept. There are five corrections to the letter dated 4-4-2014. They are:
1 ....regarding redisgantion of DGIT(Inv) of AP and Kerala as Hyderabad and Kochi respectively.
2.....regarding posts at NADT
3..... regarding rectificaiton of typographical error in bifurcation of posts of NS/LDC/Driver
4..... regarding rectificaiton of typographical error in bifurcation of posts of TA/Steno/Driver
5..... regarding rectificaiton of typographical error in bifurcation of posts of NS/LDC/Driver
6..... regarding rectificaiton of typographical error in additional vacancies to be filled through DR quota(ITI/TA/Steno GR-II)

FM TO REVIEW BUDGET COLLECITONS AND OTHER ISSUES

Finance Minister will hold a review meeting on Budget Collection for FY 2014-15 and other topics sometime during the last week of October, 2014.  Date for meeting has been solicited and shall be communicated shortly.

In the meantime a long list of reports consiting of 7 tables is being called for from all CCsIT. The tables includes columns regarding budget collections upto 20th October 2014 along with minor, major head wise and previous year collections also TDS collections and strategies taken.

LATEST DEVELOPMENTS

The Secretariat of the ITEF had its meeting, as scheduled, on 14.10.2014. The secretariat discussed the agenda items and the gist of the decisions is given below circular.
Agenda item No. 1. Immediate steps to finalise the All India seniority list of ITOs by issuing guideline and deadline to resolve inter-se seniority issue.
The Official side informed that the issue is linked to the implementation of DOPT Office Memorandum issued on the basis of Supreme Court Judgement in the case of Union Vs. NR Parmar.  Board has referred the matter raised by the JCA for implementing the same in all cadres, to the DoPT.  The reference from the DoPT is awaited and the deadline fixed for completion of the revision will not be insisted till then.      
Item No. 2. Speedy approval of Jurisdiction proposals pending with the CBDT for immediate initiation of departmental functions for FY 2014-15.
The staff side requested for notification of jurisdiction as on one side the promoted Officials are kept idle and on other side the existing assessment units are struggling with heavy work load. The staff side demanded posting of officers kept as OSD to assessment units with concomitant jurisdiction. The Chairman informed that the Jurisdiction proposals have been approved and some issues of technical nature have been referred to Ministry of Law for their opinion.  Since the new pattern is admixture of existing and new scheme, any adhoc method will bring only difficulties and informed to wait till the opinion of the Law Ministry is received.  
Item No. 3. Immediate steps for approval of RRs of Group B & C for filling up of posts of RY 2014-15 and discussion on the amendments of IRS Recruitment Rules.
The staff side pointed out that due to the delay in the approval of the RRs by the DoPT, DPC Meetings and promotions are held up and demanded executive instructions on the lines of the proposed RRs submitted to the DoPT as done during the years 2001-02 and 2002-03 during last cadre restructuring.  The Official side informed that the matter is being pursued with the DoPT and requested to wait for another month viz. till 15.11.2014.  The official side also assured the matter will be reviewed on 17th Nov. 2014 for considering the alternative methods.   In the case of IRS Recruitment Rules the Chairman directed the official side  and staff side to sit together and sort out the gray areas.                                                              `
Item No. 4 Steps to get the approval of the long pending following schemes from IFU/DoE (6 air conditioners per Range: Laptop to Inspectors, Laptops to AOs/Ps, Replacement of Old Laptops, Mobile handsets to all etc).
The Official side informed that the the clearance of approval of 6 air conditioners from DoE is expected shortly.  The IFU has cleared the proposal for laptop to Inspectors and the same will be sent to the DoE for approval.  For other issues the CIT(C&S) shall pursue the matters with the Secretary (E) and JS,IFU  for expeditious clearance.
Item No. 5. Constitution of a committee to consider amendments to the Transfer & Posting Policy for Group A Officers considering unique problems of promotee Officers.
The Chairman favoured written suggestions from ITGOA in this regard to be considered by the Board for incorporation than constituting a committee for this purpose.      
Item No.6. Discussion on the effective date of DCIT promotion to 2009/2010 Barch DCsIT and retrospective effect of promotion from 1st  January  for 2006/2007 Batch DCsIT.  Also discuss the issue of regularisation of adhoc JCIT for 2001 Batch retrospectively.
After hearing the representatives the Chairman desired the officials to start the process for holding DPC before 1.1.2015 for 2009 & 2010 batch Officers.  The official side informed that reference has been made to Law Ministry for giving effect of promotion to 2006 and 2007 batch officers from retrospective date.  The Chairman desired immediate initiation of process for regularisation of Adhoc JCsIT.  
Item No. 7. Resolution of issue of promotion orders in Directorate( Delhi Charge ) and diversion of 1633 posts out of West Bengal Charge.
The Official side informed that on the issue of Promotion orders of Directorates, the Chairman had one round of discussion with the DG(HRD) DG (Admn) and ITEF.  The contentious issue is with regard to the promotions of 48 persons.  A meeting will be held with JCA next week to find out a solution. With regard to the Diversion of posts out of West Bengal Charge, the Committee will be reconstituted with the JS (Admn) as the Chairman with mandate of completing the process within one month.      
Item No. 8. Proposal for increasing local travel reimbursement to Inspectors and Notice Servers.
It was informed that the Proposal put up with justification to the Board will be approved soon and the same will be submitted to IFU for its approval.     
Item No. 9.  Advance increment to Sr. Tax Assistants and Stgrs on passing Departmental Examination.
The Official side informed that proposal with further inputs is being put up to the Board for further action.

JCA LETTER TO CBDT ON PARMAR GUIDELINES

The GSs of ITEF  and ITGOA aka Conveners of the JCA have issued a letter dtd 29th Sept 2014, to the Chairman, CBDT requesting for amending the Advisory issued by the Board on 29th Sept. This quick response of the JCA was result of the uproar from all the quarters. While the Parmar implementation is smoothly going in all the regions though with some difficulties like data availability and doubts dates of actual seniority etc, the recent Board letter given some good clarifications and data on the issues. But, in the same letter the Board as usually raked up new issue with 'only for inspectors'.

The employees under the rule of CBDT are already being suffered losses of career progression and financial benefits due to various stands and instructions issued by the Board in earlier cases of Recruitment Rules and in the instant issue forcing the employees to seek legal redresal. The Cadre Restructure implementation processes like consequential promotions, recruitment rules and jurisdiction matters are still pending for finalisation.

AGAIN DIFFERENT STAND BY CBDT ON PARMAR ISSUE

In a letter dated 29-9-2014, the Board has issued a letter contrary to the letter issued earlier dtd 6-6-2014. This letter is with subject " Implementation of the decision of the Hon'ble Supreme Court in the case of NR Parmar (CA No. 7514-7515 and others) - Issue of Advisory — Regarding".
In its previous letter of June 2014, it is stated that " ... it is unambiguousely confirmed that the entire issue of seniority of the officers of the Income tax Department would have to be revisited in compliance of the Supreme Court Judgement.". Accordingly all CCA are under the laborious task of refixation of seniority, Most of the Task forces/committees are on their half way.
But suddenly, the Board issued today's letter in contravention to the above.

-----------The high lights of todays letter are ...
  • The letter was issued in the wake of various querries raised by CCA while they are implementing the Parmar case. 
  • Earlier, letters were issued by the Member (P&V), CBDT seeking inputs from the all Pr. CCsIT (CCA) in the matter. Based on the inputs received, extensive consultations have been carried out by Pr. DGIT(HRD) on behalf of CBDT, with representatives of Pr. CCsIT(CCAs) and the ITGOA and ITEF.
  • Minutes of the meetings held on 3'rd December, 2013 and 11th December, 2013 in the course of consultation process have been circulated to all the participants. No dissent note has been received from the participants against the Minutes of meetings. 
  •  After consultations, the following Advisory based on the common queries of the Pr. CCsIT(CCA) and other Issues that surfaced during the consultation process, are being issued in a FAQ format for uniform implementation of the revision of seniority lists in all Regions in the country, as follows : 
Gist of the FAQ is...1. Dt of seniority of DRs... In case of requistion is made in advance to the year of vacancy, then year of vacancy is to be taken for seniority. If requisiton is made after year of vacancy, then year of requisition made is to be taken.2. Effective dt of implementation ... The effective date is from 7-2-1986 and in accordance with NR Parmar judgment, But from 27-11-2014, OM dtd 4-3-2014 would be applicable.3.Is the NR Parmar decision applicable only to the post of Inspectors? ......DoPT has advised that the NR Parmar judgement Is applicable to the post of Inspectors. 4. Data regarding Requistion date vis-a-vis Vacancy year was given in the Annexure. The data only of ITIs is given for Years 1992-93 (Examination year 1991). For earlier years, it advised to obtain the dates available in the Dossiers correspondences.5. Review DPCs are required to be hold from 1986 for ITIs.

The Pr. CCsIT(CCAs) are advised to form a Task Force in their respective Regions for early implementation of the Fion'ble Supreme Court decision as per the Advisory and to complete the exercise of conducting review DPCs latest by 10.10.2014.

SOME INSIDE NEWS

Chairman's visit:

Yesterday Chairman, CBDT, Sh. K V Chowdhary visited Hyderabad and reviewed the work of Investigation and issued certain directionsd and later held a pressmeet.

The highlights of the his speech at the Pressmeet are:
  • Sectors to which the income is sourced include Mobile phone trading, Real estate,Steel, Power and Chemicals.
  • During FY.2013-14, undisclosed income detected through Surveys was to the tune of Rs. 90,000 Cr and through S&S operations it was Rs. 19,792 Cr.
  • Target fixed for FY 2014-15 is Rs.7.36 lakh Cr. which is at 15% growth. Net collections till date stand at Rs.1.51 lakh Cr after accounting a refund of Rs. 0.54 lakhs Cr.
  • A total of 22 lakh Notices were issued to Non-filers and more will be indentified in the second phase.
  • The Department will shift to software 'Income tax Business Applicaitons' from April 2015.
Recruitment Rules - Juriscition matters - Ito2Ac promotions:


In the sidelines of the Review meeting the Chairmain expressed the new RRs are pending for DOPT approval. However a draft RRs will be issued  by the DG(HRD) to all the CCAs for preparations. 

Also the Draft Gazette Notitification of jurisdiciton consequent to the CR was forwarded to CCAs for cross checking. Once, they reach back, the same will be published by 15th Sep 2014. 

As the all impediments involved in DPC for ITO to ACIT promotions are overcome and clear from all the litigations now, the most awaited DPC will be conducted very soon.

MyGov - Crowdsource governance ideas from citizens

My Country, My Government, My Voice.....

Prime Minister Sh. Narendra has started a new social net-working MyGov a citizen engagement platform. The users shall be allowed to discuss and to contribute on various government projects and plans. It also allow users to upload documents in various formats. It is also announced that a mobile phone application on 'My Gov' is also under process. The website is hosted and managed by National Informatics Centre.Prime Minister Narendra Modi stated that, this is aimed at reducing the long gap developed between the electorate and the Executive after being elected. In the first week of August 2014, My Gov received 100, 000 registered users, barely two weeks after it's initiation.[9] The platform had also attracted several users who were not previously engaged in other social media such as Facebook, twitter etc
Theme:
The Platform is divided into various groups. The objective of each group is to bring positive changes to the relevant area with people's participation. The users can select up to 4 groups for which they may engage to. In each groups, users are provided with 2 domains,'Do' and 'Discuss'. The 'Do' section includes both online and on-ground tasks for which contributors may assign themselves. The 'discuss' section may be used for discussing different relevant issues affecting the nation. It may also used for providing vital informations regarding the topic and also suggest and propose new ideas. The users are also awarded activity points based upon their individual contributions.
As of now there are seven groups to discuss,
  • Clean Ganga
  • Girl-child education
  • Swachh Bharat (Clean India)
  • Skill development
  • Digital India
  • Job creation
  • Green India
  • NRIs for India's Growth
Apart from the tasks provided users are also allowed to volunteer and submit their own entries. The entries shall be reviewed by other members and evaluated by experts and approved subsequently. Approved tasks shall earn credit points. My gov will also serve as a digital library of topics regarding India.

The 'Creative Corner' in the site is aimed at receiving creative inputs such as logo creation, wallpaper designs etc. from the general public The users are allowed to upload their proposals on the relevant topics. The users are allowed to vote on the proposals too. Though the final results are not based on the votes, the votes is also considered during the selection process by the selection committee. Thousands of inputs have been received to date.

DECLARATION OF ASSETS AND LIABLILITIES BY ALL THE PUBLIC SERVANTS.. NEW RRs TO BE FINALISED SOON.

On July 2014, the Central Governement has notified thePublic Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014.


Salient features of the said Notification are;


According this all the Central Governement employees irrespective of group A/B/C required to file Annual Return of Assets and Liablities as on 31st March of the year by 31st July of that year.


Provided that the public servants who have filed declarations, information and annual returns of property under the provisions of the rules applicable to such public servants shall file the revised declarations, information or as the case may be, annual returns as on the 1st day of August, 2014, to the competent authority on or before the 15th day of September, 2014. 


Minimum value of assets which competent authority may exempt from furnishing of information-The competent authority may, for reasons to be recorded in writing, exempt in accordance with the proviso to section 45, a public servant from filing the information in respect of any asset, if the value of such asset does not exceed four months basic pay of the public servant or rupees two lakhs, whichever is higher. 

The Return/Declaration consists of Appendix-I & II.

APPENDIX-I - Declaration form.

APPENDIX-II -  has four Forms;
FORM No. I  - Details of Public Servant, his/ her spouse and dependent children

FORM No. II - Statement of movable property on first appointment or as on the                           31st March, 20…

FORM NO. III -Statement of immovable property on first appointment or as on                             the 31st March, 20….(e.g. Lands, House, Shops, Other                                            Buildings, etc.)

FORM No. IV - Statement of Debts and Other Liabilities on first appointment                                or as on 31st March, 20…...


Accordingly one Pr CCIT, New Delhi has issued Memorandum on 14th August 2014 directing all the Group A/B/C members to file Revised declarations, information or as the case may be, annual returns as on the 1st day of August, 2014, to the competent authority on or before the 15th day of September, 2014. 


So friends, the similar Memo will be issued soon in all the regions by respective Pr.CCIT and get ready to file your own Return.

New Recruitment Rules Soon....

It is learnt that the Chairman, who was on a a tour Visakhapatam on this Saterday, the new Recruitment Rules will be finalised soon, most likely in a month. Let us be optimistic. All is well.

AT LAST THE ITEF FEELS THE HEAT

ITEF, Central HQrs, New Delhi writes letter to the Board requesting to consider consequential vacancies for the RY 2013-14 itself.

Read the full text of the letter dated 28th July 2014 as follows.....

We write this with reference to the above two instructions  issued by the Board and also the discussions the JCA representatives had with your goodself in the Quarterly Review Meeting held on 14.7.2014.    Vide the second reference dated 27.05.2014, the CCAs were required to conduct the meetings of DPCs and effect promotions for the Group B & C cadres by 5th June, 2014 for vacancy year 2013-14.
We have been getting report from our field formations that though promotion orders have been issued in almost all charges, the Cadre Controlling Authorities in some charges have not taken the consequential vacancies while conducting DPC Meetings and effecting promotions.  The reason communicated to us by our units is that some of the CCAs have taken the stand that although the vacancies are for RY 2013-14 as the promotions are being effected in the year 2014-15, the consequential vacancies will fall in the year 2014-15.   The Stand taken by the CCAs is absolutely contrary to the Instructions of the Dept. Of Per. & Trg. dated 10.4.1989 with regard to determination of vacancies for DPC.   This will also create problem and confusion in fixing the inter-se seniority of Direct Recruitees  and Promotees and may lead to unnecessary litigation if the vacancy year for the consequential vacancies of a particular year is taken to a subsequent year in some regions.    We reproduce below further clarification of para 4.1 of the said instructions of the DOPT.
“In reiteration of the aforesaid provision (para 4.1) of the DPC guidelines, dated 10.4.1989, it is hereby clarified that such vacancies arising in a particular vacancy year, as noted in the aforesaid Para 4.1, would be considered together by the DPC.  These vacancies should also included newly created posts in the same vacancy year. Hence the DPC for a particular vacancy year held subsequent to the creation of such new posts in the same vacancy year would be required to take into consideration such newly-created posts also alongwith other already existing/anticipated vacancies arising in the same vacancy year.  As a sequel to it, the zone of consideration would also get enlarged in a corresponding manner in terms of Dept. Of  Per. & Trg. OM No. 22011/1/90-Estt.(D), dated 12.10.1990 and 22.4.1992”.

Further the Dpt. Of Per & Trg in F.No. 22011/9/98-Estt(D) dated 6.10.1999 further clarified with regard to “Chain Vacancies” as under:
2. The aforesaid matter has been considered in consultation with the Union Public Service Commission.  Accordingly, it is clarified that the “chain vacancies” on account of retirement etc. in the higher grades in a vacancy (panel) year shall include:-
The vacancies which can be clearly anticipated as likely to become available in the concerned grade by promotion of Officers of the service to higher grades during that vacancy (panel)year, (Expected promotion to the higher grades under the Model Calendar for DPCs would normally be against vacancies arising by retirement in all the higher grades/hierarchy as per Paragraph 7 of the OM dated 8.9.1988).

It is clear from the above that  the consequential vacancies of the promotions effected on newly created posts for RY 2013-14 should also be taken as anticipated vacancies while determining the regular vacancies for the same year.  Therefore, the position taken by some of the CCAs need to be elucidated.  We accordingly, request the Chairman to kindly direct the concerned to issue necessary clarification to the Pr. CCsIT to effect promotions for the consequential vacancies also during the same vacancy (panel) year and to maintain uniformity in the matter.

CONGRATULATIONS TO Mr. K V CHOWDHARY AND BEST WISHES TO Ms. DEBASHREE MAJUMDAR

Mr. K V Chowdary tipped to be next CBDT Chairman

K V Chowdary , a senior officer of the Indian Revenue Service, is tipped to be appointed as the next Chief of the Central Board of Direct taxes (CBDT), replacing incumbent R K Tewari who retires this month.
K V Chowdary, a 1978 batch IRS officeris being tipped as the  next CBDT Chairman, replacing incumbent  R K Tewari who retires this month.

A 1978-batch Indian Revenue Service (IRS) officer, is currently serving as a member (Investigations) in CBDT.
Chowdary is credited with initiating a host of new steps to enhance and build up the intelligence andinvestigation set up of the Income Tax department.
He has earlier served as the Director General(Investigations) in Delhi, Income Tax ChiefCommissioner in Vishakhapatnam and Director (Investigations) in Nagpur.
When Chowdary was serving as the Director General(Investigations) in the national capital and was heading a number of high-profile I-T probes, including the 2Gspectrum allocation case and HSBC Geneva taxpayerslist.




Ms. Debashree Mazumdar

It is a matter of pride that Ms Debashree Mazumdar an employee of Income 
tax Department (West Bengal Region) has been selected to represent India in the Commonwealth Games 2014, which is's being held at Glasgow. Ms Mazumdar was recruited by Kolkata Income Tax Department in 2011. She has been declared best women Athlete in all the CRSCB All India Meets. She was in India Camps at NIS Patiala. The Indian athletics team for the Glasgow 2014 commonwealth games will have 32 athletes. There will be 15 men and 17 women athletes participating in this year's common wealth games. 

She is a team member in Womens 4x400 relay.
This event is sheduled on 1st August 2014 at 23.21 IST.
