LATEST NEWS FROM THE BOARD ON VARIOUS MATTERS

New Recruitment Rules for Group A,B and Group C posts:


The draft Recruitment Rules for Group “A” , “B” and "C" officers including A.O./P.S. of the Department had been submitted for approval of Hon’ble FM before referring to DoPT, and the Board informed the same are being pursued for early approval. It was also made clear that promotion to the Group ‘B’ and ‘C’ posts for recruitment year 2014-15 can’t be made on the model RRs. So consequential promotions can be given only on the approved and New Recruitment Rules. 


Re-look on the allocation of CR posts and not to reduce any posts in future in any charge:


On the reqest of the JCA, to re-look in the allocation of CR posts and not to reduce any posts in future in any charge, the Board has informed the JCA, that a committee is being constituted to look into the issues of reduction in post in Kolkata region and other issues. They were advised to bring the issue before the Committee.


No Advisory on the NRP implementation:


The Board has made it clear that it is not possible to issue an Advisory to the CCAs. It was informed that Advisory in the form of FAQs prepared by HRD was not touched by DoPT and DoLA while giving advice/clarification on the implementation of the decision of the Apex Court in month of March. The Board has categorically made clear that without the approval of DoPT the Board is not competent to issue such advisory as it would complicate the matter and there will be flood of litigation leading to more delay in the preparation of the All India Seniority List of ITO.  They were also informed that the issue of advisory in the form of FAQs will be relooked after discussion with HRD and thereafter advisory will be issued along with time limit.


Implementation of following schemes approved by the Board and still pending approval at IFU/DoE:

(i)   Six Air Conditioners per Range for staff rooms.

(ii)  Laptops to Inspectors.

(iii) Mobile handset to all personnel in the Department.

(iv) Increase in the reimbursement of local travel expenses to Inspectors and Notice Servers.


Pr. CCIT (Logistics) informed that the file containing the proposal of six Air Conditioners per Range has been received back several time from Department of Expenditure. The fresh queries raised by them are being replied shortly.


She also told that the file containing the proposal of Laptops to Inspectors and mobile handsets to all personnel in the Department has also been returned by Department of Expenditure with fresh queries and the file is being re-submitted with replies with reference to the queries raised by DoE.


It was decided that the proposal for increase in the reimbursement of local travel expenses to Inspectors and Notice Servers will be put up in the Board meeting before referring the proposal to DoE. (click here for copy of the draft minutes of the QRM held on 14th July 2014.)



Financial Benefit on promotion in the same grade pay and Advance Increment to Sr. Tax Assistants on passing ITI Examination:

The OM dated 15th July has been issued regarding financial benefit on promotion in the same grade pay. The proposal regarding Advance Increment to Sr. Tax Assistants on passing ITI Examination will be favorably expedited by HRD. (click her for copy of the OM)


Miscellanious Matters:


Post Migration of Data Centre, a team of officers of Directorate(Systems) will get in touch with complainants and get their feedback so as to understand whether the complaints have been closed after due satisfaction of user. The team's contact details were circulated.


A Committee to study the appellate orders to examine the filing of appeals by the Department before various forums of CsIT (A) & ITAT has been constituted and it has to suggest steps to reduce litigation before these forums. The Committee shall submit its report within 8 weeks from the date of its constitution.

Some of our ITEF leaders worried for the early promotions of junior cadres but playing their dirty politics againn n again with the senior cadres such as OS. It had already happned in 2001 re_structuring.

New rules should not be retrospective only prospective. The cr/vacancies arised only before the new rr (after notifying by dopt only taken into consideration) so rect.year 2013-14 and 2014-15 including regular vacancies and cr vacancies should be given in old rr

U r mistaken dear. There wil be no new R.R. Iis there any regular RR for ITI till date. Admn n ITEF isIin the view that department's all work only handled by only some cadres such as ITO, ITI or STA/TA. They r getting the promotions of OS only to get financial benefits. So don't think that there will be new RR for AO or any other cadre

Yes. You r right.the senior most putting more than 28 and above in the cadre OS still sitting as OS. Itef plays. They r not worried about seniors

The 6th pay commission suggested that excess staff car drivers should be integrated to main stream .Now it is 8 years past. Nobody is thinking about the cadre .They are deprived of all their future carrier progression.

Graduate Driver should be made ITI as they will better investigate as compare Dr ITI. Drivers are well acquainted with geographical area and it will better help to the deptt.

Remaining vacancies for13-14 &14-15 have arisen before notification of new rr. Hence these should be filled in through old rr as per dopt's 89 OM.

in bihar charge consequencial vacancies are taken for R.Y. 2013-14 itself. Now it is clear that it should be taken for R.Y. 2014-15. It is now important to demand for review the DPC for ITI order in bihar imediately.

irrespective of vacancy year, the consequential vacancy comes into effect only aftr joining of incumbent..all d restructure ito posts are filled up in 14-15 only and d consequential vacancies falls in 14-15 only..bt how come they filled them vn board circular clearly stops them to do so? responsibility shud b fixed on erring officers..

i doubt whether the new r.rs will come in this year? our itef leaders will sit there in dopt and make it sure that new r.rs wont comeso that stenos can get benefit. Just wait and watch, another circular will come from ddit(hrd) to conduct dpc for 14-15 with old rules.'Hyd cat case only stoping them for doing that.

Like Hyderabad region, all OS/Sr.TAs should approach respective CAT for implementation of the cabinet approved Model RRs for the RY 2013-14 itself.

The new RR will remove a lot of anomalies anf grievances that have crept in the department. Stenos are an important part of department but the quota (25%) is unconstitutional and against right to basisc equalities. I am a candidate of SC/ST and we are given 22.5 % reservation for attrocities faced by our forefathers.
But there is no backwardness among stenos..and as such the qouta system ought to be abolished.
The new RR will remove this major anomaly.

In state of Rajasthan three cases have been filed by 19 candidates on basis of Hyderabad CAT decission. Two cases are in CAT jodhpur and third in CAT jaipur.
Other states should also take lead.
All are trying for implemantation of new RR.
The FM would approve same but it will be stalled by steno lobby at DOPT for which all have to be prepared.

In Gujarat Zone, some Senior TAs who joined the department in October’ 2007 and in the grade pay of Rs 4200/- since June’ 2011 and passed the dept. exam of ITI on 2009 & 2010 are still waiting for promotion to the grade of ITI even after the post of cadre restructuring post finished also. Some of this batch may become ITI in 2015, 2016, 2017 & 2020 also.
On the contrary, some stenos joined in January 2009 in PB-1, Grade pay of Rs 2400/-. They passed dept. exam of ITI in Dec 28th 2012 and get promoted to the grade of ITI PB-2 Grade Pay Rs.4600/- in Apr 2013.
It seems that department is waiting for the stenos that as and when they get three years & pass exam of ITI they get promotion.
Isnt it injustice to these Stenos? They should have been promoted after completing TWO YEARS only and not need to pass exam, as they are favored by the most eligible leaders of ITEF, CHQ, Delhi. As ITEF is never in this view for equity & justice for ministerial cadre also.
The matter of promotion ratio should be reviewed by DOPT & CBDT.

For the information of everybody, New RR can not be approved by DOPT even if approved by Finance Ministry because old RR will be valid
till the date of issue of notification of New RR. DPC for vacancy year 2014-15 is already due and new RR have not given effect. Regarding this DOPT's circular also exists. So it is not possible to implement New RR for RY 2014. According to the principle of natural justice, New RR should not be implemented to the employees who have joined on or before 23.05.2013. This will spoil the career of those employees who have left other deptt for better career opportunities in the IT deptt. Their dream will be spoiled.

Model RR recommended by cabinet for CR is already existed. Hence, there is no necessity that existing RR should be followed till new RR.

The CBDT submitted its proposal only. If u book a bus / train berth for your journey, there may be chances of breakdown / cancellation / postponement.
So don't think about New RR.
Think about OLD RR only.
Get ready for 3:1 for the consequences WITHIN this year and WITHOUT new RR.

Sriman July 23 @ 1:46 pm, framing and finalising of RR is not the duty of cabinet, it is the duty and authority of DOPTs. So new RR will only be approved by Respected DOPT. Then CBDT is the implementing authority. Cabinet has approved only the new post allocations with infrastructure. Is that clear. Establishment ke bare me thoda padha karo mere yaar, khali assessment mein kam karogo to kabhi bhi revert ho skate ho.

Cadre restructuring was approved by the cabinet, creating new cadres like Pr.CCIT, Pr.CIT & EA.
The additional posts allocated due to implementation of CR for all cadres are being filled up in the RY 2013-14.
For RY 2013-14 vacancy itself, Pr.CCIT promotion was effected and also steps are being taken for the promotion to the new cadre Pr.CIT for the RY 2013-14 itself.
But EA cadre was not effected for the RY 2013-14.
When all new cadres are promoted on RY 13-14 vacancies, Why EA was neglected?
All os/ Sr.TAs has to ask this to ITEF. So that all their seniority will be revised, ahead of stenos.

Things are moving very badly only because every one thinks and acts which suits him or her in a better way ignoring the other better options available.

PCCIT, PCIT and EA are new creations in one or the other way. The posts of PCCIT has already been created and PCIT is in pipeline , then why not EA?

Once higher level posts created without new rr, why not EA posts.

Whether new rr for those higher responsible posts are required or not? Can these posts be filled or created without rr?

Once these posts can be created or filled without new rr why not posts bearing less resposibilities be filled without new rr? Higher rank officers who are retiring with enhanced pensionary benefits because of CR, but poor Gr. B &C employees are retiring without it. Rule position gets changed person to person.

Once the suggestions of Service Associations are made as law in toto , what is the necessity for HRD. At least we can use those manpower in productive area.

IRS officers in all levels lack qualities needed for HR management. Their sole aim is not to allow the benefit of CR to non-IRS to the entant possible. So, CBDT and HRD must have IAS as its head. Had there been IAS officer as CBDT head, the CR would have been implemented long back.He could have dealt the imperialistic attitude of IRS association and false leftist theories adopted by ITEF in a better way.

New RR vs Old RR:
People are fighting over it without understanding the impact and fairness. ITEF is all concerned about a select few in steno & Sr.TA grade for their promo to ITI hence it wants New RR.
The existing benefit of passing the dept exam earlier is sacrificed.
If new RR comes, it will come for all grades. The impact will be that:
ITOs will have to clear exam for ACIT, a new roadbock, and half of the Exe.Asst post would now not be available for TAs since these would go to SSC direct recruits.

In CR addl 3800 posts were created at Inspector level. Under existing RR, distribution would have been as follows: 950 from steno grade and out of the balance 2850 posts, 1425 would have been reserved based on pure seniority and the rest 1425 based on the year of passing criteria.
ITEF insisted on abolishing this criteria of year of passing and thus block benefit to 1425 candidates who otherwise would have been eligible.
Now once new RR comes, out of the additional posts of approx 6000, created in Sr. TA (E.A) grade, promotion benefit would now be available only upto 50%, to departmental candidates (existing TAs) and the rest 3000 would go to outsiders (through SSC).
By blocking the promotion of 1425 Sr.TAs to the post of ITI( with the credit of passing the dept exam earlier), they have given benefit to persons senior by age. To some this may look o.k., but at the same time they have deprived 3000 existing dept candidates viz.,TAs from promotion to Sr.TAs\EAs.
Would these sacrificial goats understand the game played by ITEF?
Whose interest ITEF is serving?

A lot of hanky panky is going on.
In Mumbai circle the preparatory work for ITO promotion was done with total transparency. Each and every candidate's case was reviewed with reference to NRP case verdict and CBDT guidenines. A lot of clarificatory office orders were issued to correct the seniority list with reference to requisitions given to SSC for appointment and other criterion.
And finally the eligibility list was drawn.
But for promotion to ITI, no such base work was done and this is obvious from the lack of all such details in the eligibility list drawn up.
Nothing has been mentioned about the requisition date given to SSC for their appointment as TAs to compare the same with other depatmental promotees\compassionate appointees.
seniority list has been drawn on certain parameters which have inherent flaws. Seniority list of Sr.TAs have been drawn based on their entry to the feeder grade, i.e grade of Sr.TA. But seniority of such candidates at the Sr.TA level should have been drawn keeping two things in mind, first one is revision in their seniority at TA level entry with reference to date of requisition given to SSC vis -a-vis corresponding date for depatmental promotees\compassionate appointees, and second one being the cases of inter-charge transfers for whom the date of joining Mumbai Office should been the criteria but Mumbai circle has given them the benefit of the service rendered in the erstwhile dept before transfer( this is against the rule laid down by CBDT).
The recently promoted ITIs ( from their future career prospect point of view) and those who have not got the promotion should look into this, before it is too late
