PARMAR CASE DISCUSSIONS
Hello friends,
It is learnt that the DR ITIs from AP have got stay on conducting DPC for ITI to ITO in the last month from CAT, Hyd. But the some of PRs from AP were able to get the Stay vacated in the HC. It is learnt that the ground that they represented before the HC are ...... the stay was granted for only 2005 batch, there are only five vacancies mentioned in the 2005 Notification, and the Dept is unable to implement the Judgement of the SC in N R Parmar case due legal implications and practical problems, and we are loosing the all India seniority even the actual vacancies araised so far in AP are more than five, even those five are not from AP charge, so by reserving those five posts the remaining posts can be filled up. And hence the HC decided accordingly in their favour with a condition to revise the seniority in future if any.
Here the points to worth mention are...
1. Is such Notification really specified the number of vacancies ?
2. Though SSC issues Notification with out exact number vacancies on hand, whether the SSC recruits more than the candidates requested from the Depts.?
3. In any notification, if at all vacancies are specified, is it says that is final figure ? or says a tentative one ?
4. If any Dept/State unable to report the vacancies due to various reasons, to the SSC before the Notification date and subsequently reported the actual vacancies which are actually pertain period ended before the Notification date. Then can any conclude that those later reported vacancies doesnt pertain to that Notification?
The answers to the above questions are well known to all and I think these will also well answer the PR petitioners friends. I hope they have not given false statements before the Court or not misleaded the Hon' ble Judge. We cant conclude with out seeing the actual order.
Also it learnt that a review DPC is being conducted in TN charge. further details are not known. Can any body from TN charge update the news in the comments section or mail.
