After the announcement of agitational program on the matter of implementation of Cadre Restructuring of Income Tax Department, now the JCA Delhi has decided to withhold the agitation starting from 19.3.2014 till further information.As per the information gathered, the Member (P & V), CBDT has called the ITEF, Delhi Circle to meet and discuss the matter on 18.3.2013. In the meeting she has intimated that official meeting with the Secretary (Revenue) has been fixed for 19.3.2014 and assured that the Board is making all out efforts to expedite the implementation of the Cadre Restructuring and requested to postpone the agitation till the outcome of the said presentation with the Revenue Secretary. It is also informed that the assurance given by the Member (P & V), CBDT is conveyed in writing to the ITEF, Delhi Circle through the office of the CCIT (CCA), New Delhi.

............. In our view, in states where seniority in
the cadres of Inspectorshave been fixed overlooking the principles laid
down vide DOPT O.M.dated 070.2.1986/03.07.1986 or with some
aberrations or with otherwiseinterpretation and / or which has been
challenged , will be consideredas unsettled seniority list and needs to be
revised accordingly inpursuance of Para 5(i) of the DOPT's
aforementioned O.M. for settlingthe same afresh. Further, since the DOPT OM
dated 03.03.2008 has been treated as non-existent/ withdrawn ab initio, the
seniority fixed under that OM needs to be re-fixed as per the latest OM dated
04.03.2014. It is therefore requested to kindly issue clarification as to in
which cases the seniority is to be settled as per latest O.M...........
In view of above narrated facts, we would like to request your honourto kindly issue proper guidelines/ clarification for its uniformimplementation as stated above. There is urgent need to attend thisproblem as the promotions in all cadres are stayed by judicialauthorities, which is jeopardizing the career prospects of themembers of this esteemed Association. "
ITGOA's letter dated 14th March and CBDT letter is dated 15th March 2014. So, can it be expected that the Priciples laid down in the OM dated 4-3-2014 are to be implemented even for the cases of prior 2012 ?

ITEF, Delhi Circle is suggested not to believe upon the assurances given by the Board and continue its proposed agitational programme, as holding talk is one of the delaying techinques adopted by Board since long with regard to finalisation of CR. It is also suggested to motivate all the ITEF circles, so that pressure may be exerted on the Board for early implementation of CR.
From DoPT's OM dt 4th Mar 14, it transpires that the cases prior to 27.11.12, where the seniority was decided as per 1986 guideline, would stand as it is. The cases where seniority was decided not following 1986 guidelines, need to be revisited.
And the cases decided as per OM dt 3.3.2008 would certainly qualify for reconsideration.

Let me intimate the outcome of the discussions held with Revenue Secretary in the matter of CR on 19.3.2014.
The Board has approved the CR and sent to the FM through RS on 28.2.2014. However, the CR file has not been endorsed to the Hon'ble FM till date and is still pending with RS.
The RS is going to retire this month and it seems like the CBDT Chairperson, he would take the decision of the very last day i.e. on the day of his retirement.
But, the million dollar question is that- in the present Election time is Hon’ble FM would be available for disposal of such type of file?
The Board has taken 10 months to finalize the CR file, RS is taking its own time in finalization of CR file, then can you imagine that the FM would not take its own time for taking any decision?
In the present election time, it seems very hard that the CR would be finalised?
But, our representatives are ignoring such type of happenings and remain kept mum on finalization of CR.
Hope, the new Government would finalise the same?
CR is underway in CBEC as well where multiple unions exist. Govt knows spending on revenue department is a long time profitable investment. IRS people used this occassion to their advantage by equaling their pay with IAS (apex scale) and got increased 2 more steps in their ladder where as we lost 1 step (OS). So our associations can not claim CR is the big achievement of federation. Govt has linked CR with revenue collection. Hence CR is a need of the hour to generate more income to Govt. IRS have used it for their ascend , but federation failed on this account. Strength of the union lies in effective support of its members. Presently most members are unhappy with union. Even today 90% members don't know what was the proposal submitted by ITEF in sub committees and what is the difference in terms of number in charge wise distribution of manpowe between the federation proposal and core committee report. ITEF wants to be hero by portraying core committee as villain. First let us set right ourselves. Communication gap between members and leaders of federation is to be removed. Only handful of people knows what is going on in federation , others don't know and don't have any say . Remove communication gap. Go for open house discussion on important matters.
CR was a mirage and now has been turned into a joke.
It seems nobody who matters, is interested in CR.

The charges break the rule.
They were merrily interpreting rules as per their convenience and in connivance with the ITEF.
Now the Apex court verdict has become a bane instead of a boon.
Will it be able to bring an end to the corrupt way the Charges used to settle seniority?
I know a case where a candidate who appears the Dept exam under Gen Category, gets promotion under Scheduled Caste category.
You are right.
Appointment letter says that no request would be entertained for inter-charge transfer.
The rule says that on inter-charge transfer, the employee would lose weightage for the period of servoice rendered in the erswhile Charge.
Cases are there where requests are entertained, a candidate gets a transfer of his choice and then gets promotion with due ( which in fact is undue) consideration of the period of service rendered in the erstwhile charge.
CR will happen only after the dept exam results for 2014 are out.
This is the game of ITEF, and CBDT is playing into its hand.

intercharge transfer ke bare me jo cbdt hrd se 18.02.2014 ka letter nikala hai us letter me Jinki spouse PSU me kam karti hai unke bare me kyon nahi likha gaya. CBDT hrd me jo baithe hai Unko malum nahi hai ki DOPT ke niyamanusar ye galat hai. jabki central excise CBEC me PSU likha gaya hai.
