CR UPDATES

It is learnt from the reliable sources and from the close associates of Ministry of Finance, that the CR file is vetted by the Fianance Minister and the same is returned to the CBDT for further action. The source is of the news, independent to any other site. Next process of implementation, i.e. issue of Notification is expected in a week's time. This can be treaed as almost confirmed news but not 100 percent, since, it is to be officially confirmed by the CBDT only.

DEVELOPMENTS ON NR PARMAR ISSUE & IMPLEMENTATION

It is learnt that the newly elected body of ITGOA has met the DG/DIRT(HRD) and MEMBER(P) in this week. They intimated the developments on various issues like ITO2AC promotions, IRS Recruitments rules and implementation of Judgement in NR Parmar case etc. The matter relevant to the most fiery issue i.e. NR Parmar is as under: 

 Issue of uniform guidelines on implementation of the Hon’ble Supreme Court judgement in N R Parmar case

 The CHQ was informed by the HRD on 04/03/2014 that as per the advice of the DOPT, the Department of Legal Affairs (DOLA) was requested to extend their advice on this issue. While the CHQ was discussing the matter with the DIT(HRD)-II, the advice of DOLA was received. We then requested the DIT(HRD)-II for immediate issuance of uniform guidelines to all the CCsIT. He assured to do the same within 7 days. In the meantime, in the evening of 04/03/2014, it came to the notice that the DOPT has issued its OM dated 04/03/2014 formulating the modalities for fixation of the inter-se-seniority between the direct recruits and promotes. The issue was discussed with the Member(P) on 05/03/2014 and she was requested to issue uniform guidelines on implementation of the  Hon’ble Supreme Court judgement in N R Parmar case taking into account the advice of DOLA and the OM of the DOPT to remove all doubts forever. We also requested for a time bound implementation of the matter so that the overdue promotions can be given effect early. The Member(P) assured that the necessary instructions will be issued to the officials concerned.

CONTRASTING PRINCPLES OF DOPT - ISSUES ANOTHER OM ON SC JUDGEMENT IN PARMAR CASE

Again the DOPT is withdrawing the OM issued in 2008 on interse seniority and resorting to 1986 OMs. On one side  it is contemplating the SC's Judgement and reiterating the true meaning of the 1986 OM in the same lines interpreted by the SC, but on the other side it is ruling this could be effective only from Nov 2012 i.e. date of Judgement. One could wonder, how a OM issued in 1986 is effective only from Nov 2012.  Also, it is stating that the for the people for whom the matter is settled in the lines of 1986 OM/SC Judgement, can not be reopened.
What do you call this standard of the DOPT?
Can an OM issued some 30 years ago can be implemented prospectively from 2012 only ?
