DIVERTION OF NATURAL JUSTICE TO PRIVILEGED... OPEN LETTER TO WB JAC... CR UPDATES.

(HERE IS A OPEN LETTER TO WEST BENGAL REGION LEADERS FROM AN ANONYMOUS)

Procedural fairness is part of our cultural heritage. It is deeply rooted in our law. It lies at the heart of the judicial function and conditions the exercise of a large array of administrative powers affecting the rights, duties, privileges and immunities of individuals and organisations.

When we look in to the history, the legendary personalities of West Bengal have glorified the name of their homeland as well as the Nation. Be it science, religion, politics, music, dance, leterature, films or any field, the Bengalies have excelled without any limitation. Many stalwarts from the Nation like Swami Vivekananda, Rama Krishna, Aurobindo Gosh, Tagore, Bose are from the land of West Bengal. The entire Nation has a special reverance towards Bengalies.

In one of its latest posts of a well known simple blog it is stating "..........It is really an irony of fate that when WB JCA is on agitation demanding more posts for their region, CBDT is taking away posts from this already deprived region." In most of the earlier occations the simple blog authors who are apparantly hailed from WB showing vested interests towards their region.

The demands of the WB region appears to be genuine for them selves but they should try to continue the legacy to some extent. The principle of natural justice will apply to all the fellow employees of the Income tax Department. In all the cadres there is huge stagnation. The officials from West Bengal should open up their minds and should have broad views. So far, since 2001, they have enjoyed the promotions like none other region in the entire Nation. Now, the time has come to cease this inequality and should come forward to accept the ground reality.

CR UPDATES:As informed earleir in this blog, A kick-off conference to discuss the " Cadre Restructuring Plan: Scheme for Distribution of Posts" is going to be held on 15th April at 11.00 AM at New Delhi. All the concerned Addl.CIT(HQrs) and Chairman, Local Imlementation Committee are directed to attend the meeting along with draft jurisdiction proposals for discussion.

CADRE RESTRUCTURE - VIDEO CONFERENCE - HIGHLIGHTS

Some of the high lights of the Video Conference with regard to Cadre restructure among other items are as under:

  • Chairman Mr. R K Tewari congratulated all the members of the ITD and the Member(IT) Mrs. Anita Kapur has appraised the CR committee members for successfull completion of their task.
  • The Chairman has confirmed that for promotions the CCIT, Principal CIT and CIT, it is requested the UPSC to conduct the DPC and sooner the date of DPC will be announced by the UPSC. 
  • Member(IT) has shown the booklet containing the norms of the CR which contains the detailed Charge wise allocaiton of posts and other matters.
  • Member(A&J) demonstrated the Road map of the CR implementation. Most of the points uttered by the Member are inaudible and some of the points are the Region-wise allocation will be forwarded to all CCAs this week itself.
  • Requested all the CCAs to conduct the DPCs soon after the receipt of the Norms.
  • New offices in the districts should be finalised with in 10 to 15 days.
  • Addl.CIT(Admn)s will be consulted and Jurisdictions and Infracture matters will be finalised on 15th April.
  • One of the CCIT has requested for the uniform date of DPC should be followed and the Chairman assuered the same. Then CCIT, Mumbai informed his inability to conduct DPC for ITO as there is a stay granted by CAT.
